Re: First Registration of two pre-Norman Spring well sites without title. Will a ST3 Statement to the effect that 'is is not known whether deeds were lost destroyed or never existed in the first place' be a valid and acceptable statement to make?

Steve - it would be an odd statement of truth to try and prove title that way. I'm assuming your are not the legal owner as presumably you'd know if you'd lost the deeds. As such if you are trying to claim ownership then PG 5 is the guidance you require https://www.gov.uk/government/publications/adverse-possession-of-1-unregistered-land-and-2-registered-land-where-a-right-to-be-registered-was-acquired-before-13-october-2003-pg5

Please do seek legal advice either way as the law re such matters is very complex and you need to satisfy the legal requirements before you tackle the registration ones

Adam Many thanks for your response. No CTWCC is seeking ownership. We are trying to assist out LA to acknowledge its defscto ownership arising for it recorded maintainable of three pre Norman Spring Wells from 1974 - 2016 AND all its Municipal forebears dating back the earliest, 1553, Court Lee entry. This evidence is, we are advised, sufficient to support a First Registraion application for sites where no Deeds can be found. The question is "Will the Statement "It is not known whether deeds were lost, destroyed or ever existed in the first place" in response to ST3 form question - 'Where are the Deeds to this site' (I precis that Question) ' Our Research certainly confirms that many early Norman and pre Norman sites lack evidence of the existence of Deed and it not impossible the deeds never existed in the first place. Our three town well all have Anglo Aston names are one of the prime reasons fir the existancexof Clitheroe/Clyderhow. We have records of one fiflghting man sent bu Orme the Englishman in response to a call to arms from Eorl Loefric of Mecia. By this extension to the ST3 Giidance notes, we seek to make this statement as comprehensive as possible. Some claim that to make such a statement would be 'deceitful illegal and unlawful'. Our legal adive contests this. We are now seeking further advice and comment on the validity if such a statement as were also advised that the only issue preventing such an approach by our Distric Borough Council "is the will to do so" ! Our Concil accepts the principle of ownership- after nine years of campaigning to persuade them to do so. For some reason they wish to presue the Complusory Purchae option which is more complex, more expensive and is likely to get list in the impending transition into a Unitary Authority on 1st April 2028.
