Hi, I am writing as the home seller (Kwabena). An AP1 application regarding my garage (Title: K924159 / Application Reference: J932ZKV) has officially passed its 10-day expedite window. My solicitor received an email update yesterday afternoon (Ref: 260708-6412883) confirming that the matter has been referred to a senior officer for technical guidance. However, my buyer issued a final warning that they are pulling out of the purchase in two weeks if the title isn't issued by then. Today is the deadline and I am trying everything to negotiate and keep them in it. If this chain collapses, it will cause me severe financial hardship. Can a forum team leader please contact the regional processing office directly to see if the Senior Officer can look at this file and manually finalise the application today? My entire house sale hangs completely on this single garage title being updated. All over work and enquiries is already complete. Thank you for your urgent help.

Thanks Adam. It is possible to get me an update on where they are with it? And if possible to complete by today? It should be just a name change from previous owner to my name from what my solicitors tell me

Kwabena - we can't offer a specific update service as that's the responsibility of the casework team and the lawyer referral process. The application is to make an alteration to the already registered information and to my mind that is not as simple as has perhaps been explained. But the devil will be in the detail and what supporting evidence the solicitor has provided to enable such a change to be made.

Hi Adam. The context is that I purchase this property 4 years ago, with the leasehold title of the garage attached to the main house freehold title. But for some reason, the main house freehold title was correctly registered in my name but the garage title wasn't done (still in previous seller name). So we are trying to re-register it into my name. We had to get the previous seller solicitor's permission for the registration which took longer than expected, so my buyer is reaching the boiling point and my purchase is also being affected. All the process for my purchase has been done since early May. We were hoping for a mid/end July complete. Only thing holding this up is this title, both my sale and my purchase is at risk. I appreciate you can't give specific update but I would appreciate if anything can be done today please.

Hi Kwabena - all noted and appreciated and I have flagged it with our lawyers and the casework team as requested. In light of what has been requested and the referral I very much doubt if anything can be done as swiftly as you need it to be. Your conveyancer will get a response as soon as possible as a result.

Kwabena - there is no definitive timescale as we must wait for the lawyers to consider it. The expedite request was granted and processing started within the 10 days quoted. Expedition does not mean it is completed within 10 days and it needs to be considered by our lawyers because your conveyancer is asking us to replace an already registered transfer with an amended one.

Is there no possibilities for your lawyers to give an estimate time frame or range? This will help me negotiate and fight to keep my sale and purchase alive. At the moment, you are saying you dont know/ implying the lawyers hasnt considered it and I can't negotiate with this. I thought the Expedite request was to help escalate the process for people whose sales are in danger. Also, what do you mean by already registered transfer with an amended one? My lawyer says it should be updating the title to me, the correct owner. As I mentioned, I bought the property 5 years ago, so Im not understanding what is meant by already registered transfer when the title isnt registered to me, and still in the previous seller's name

Kwabena - the escalated referral usually means next steps are confirmed within 72 hours. We should no more Monday hopefully The expedite process does help escalate the process as in moving the unactioned application to the front of the queue along with other expedites of course. The solicitor has asked us to accept an amended 2021 transfer. That 2021 transfer is already registered and they want to replace it with an amended one. I would suggest speaking to your solicitor to clarify what they have asked us to do

Ok, but it is a matter of days or weeks or months? Its still sounds vague so I dont know how to use this information to help keep my sale. Any possibilities for the lawyer to send their questions or requisitions today since it would have hit the 72 mark from the original escalation by my solicitors after the 10 day or do you mean from your team? Re the transfer, are you suggesting that the original transfer was done wrong in 2021 when I bought the property? I was told that it wasnt filed at all, so it had to get re- registered

Kwabena - all you can say is that it is with HMLR, it has been escalated and we expect a response early next week. There is a limit to what else I can advise on as it would be conjecture on my part re the specifics as one of our lawyers needs to provide the answer. And as far as the application made by your conveyancer then that's for them to explain to you in more detail if needed. Once the casework team have issued the lawyer's reply to your conveyancer I can try to explain things from a general point of view but again that's something your conveyancer should also be doing for you.

Kwabena - it has been referred to our lawyers and escalated. Once a lawyer has picked it up and provided next steps the casework team will notify your conveyancer as appropriate. By all means ask for a progress update again on Monday. If anything happens sooner and over the weekend I will let you know.

Hi Kwabena - the casework team need more from the conveyancer before they can proceed. I have asked them to ting the conveyancer today if possible to escalate the request. I'll update here when that call/request has been made K924159

Hi Adam - my solicitors said she called the casework team and they said its still being dealt with the senior legal team and no questions were raised. I thought you mentioned they had questions but no one brought up the questions. My solicitor is ready to address this today, can you please ping them?

Hi Kwabena - your solicitors spoke to the support team, not the casework team and they would not be aware of the next steps to be taken. They explained how the matter had been escalated. I have done the same and will chase the casework team again
