Arthur - in my experience it is often much sooner than the 10th day.
Post again Monday PM and we can check again although I must stress the complexity of the application does mean that it will be processed by a caseworker but will also need to be considered by a senior technician to ensure the specific complexities are ironed out/all ok
To that end we should know more quickly as the caseworker will flag any obvious issues. But it may take a few more days before we know for sure.
I'll check in with the casework team after that first step is taken and see if we can promote it in some way depending on processing points involved.

I will come back on Monday.
All the best.

Hi Adam.
I hope you've had restful weekend.
Could you tell me if there is any progress with new application please?
Kind Regards
Arthur

Hi Arthur - the good news, albeit small, is that it has now been processed but the bad news is that the application has been cancelled. The applicant has been notified in writing with an explanation as to their options as we see them.
The cancellation of the application should not, hopefully, negate the opportunity for the sale/purchase to continue. There is a way forward but of course much will depend on your legal advice and/or mortgage lender. They will be best placed to advise next steps and confirm the options available

Hi Adam,

I hope you are well.

On the 4th of June, the seller's solicitor wrote the following email to my solicitor:

"I received a call from the Land Registry on Friday of last week indicating that the application to disapply should be linked with your application to register. The Land Registry also indicated that I should write to another address for Curzon Estates Limited, which I have done. It indicated that this will assist the application should I receive no reply to that letter. The Land Registry is to write to me in more detail outlining its requirements. As soon as I have any further information, I will revert back to you."

Would you be so kind as to ask the Land Registry to send the email detailing its requirements sooner rather than later, please?

I know it is a lot to ask, and I am aware of being a pain in the neck, but you can clearly see what I am dealing with. Six months have passed, and two addresses were given, but only one was used in an attempt to contact Curzon Estates. The first application moved forward after two months of being idle, only thanks to you.

My solicitor stresses that the whole point of the application is to ensure that we do not find ourselves in a position where we complete and then cannot register. We need clear information from the Land Registry on how to avoid that situation.

All the best
Arthur

Hi Arthur - the letter of cancellation issued on 3rd June explains what's needed etc so there's nothing still to be sent.
IF they are successful in disapplying the restriction in the way that has been explained to them then your transaction can complete in my experience.
The key issue for you/your conveyancer is that disapplication of the restriction essentially sets it aside to allow your transaction to be registered. The restriction then remains on the register.
So you have not been a pain in the neck and the position is already out there with the seller's conveyancer. Hopefully they are working on their application to disapply the restriction with regards your specific transaction
Hope that helps to understand that the ball is in the seller's court and not ours

Thank you very much, Adam.

Without your help, my conveyancer and I would still be in the dark.

All the best,

Arthur

P.S. I have no issue with the restriction being assigned to me for compliance.

Arthur - understood and appreciated. Hopefully your conveyancer can progress matters with the seller's conveyancer as a result.
Always worth considering the 'future' re the restriction and it's impact as well but no doubt your conveyancer has already covered that off with you hence your having no issue
Key next step therefore is the seller's conveyancer to make the application to disapply as guided. Then they need to request expedition as a separate request to get it moving. It's a new application so the clock and process restarts at our end.
Feel free to post again when you know they have applied and if not expedited we can hopefully flag it as such from this end anyway.
