Hi, can you provide an update on a pending application for WSX46880, the Land Registry reference is F293HXT. The property is currently being sold and this matter is holding up the entire chain, I understand that this was expediated by the conveyancer on the 23rd June 2025, do you know how much longer this is going to take?

Hi Nicola - the application was submitted in June and is waiting to be processed. That's not going to be for several months based on current average timescales
It's not been expedited and I can't see a request to do so - Request an expedite - GOV.UK
Expedition gets the application to the processing start line quicker (within 10 days normally). Everything then hinges on it being in order 
I'll flag with the casework team to expedite it and they will contact the conveyancer to iron out any issues

Hi Adam, thank you for the prompt response. The conveyancer advised the below - 

"We are writing to inform you that we have contacted the Land Registry regarding your application. They have confirmed that our application is being treated as a priority. Please find the attached confirmation for your reference."

I have attached the attachment that they also sent, can you double check if the expedition has definitely not been received as they seem to believe they have been in contact with land registry and it has been confirmed that it is being treated as a priority?

Hi Nicola - many thanks but the attachment is simply the confirmation they obtain when making an 'Application enquiry' (see header. They can do that at anytime to check and confirm the application is pending. That's not confirmation that it has been expedited 
The reference to 'priority' towards the end of the document relates to the fact that the priority of the application is protected from the date of submission. Nothing to do with expedition for example
If they ever want to request expedition then they should use the linked guidance I shared in the previous post. They have not made such a request.
But I've flagged it with the casework team as mentioned so whether they now request it or not it doesn't matter as already expedited based on your own post

Hi Adam, I understand that a requisition was raised on 24th July and replied to on the same day, I believe it was just a copy of the grant of probate that was required. Can you please provide an update as I cannot see anything further has happened since the 24th July? Apologies to be chasing but there is a lengthy chain that is at risk while we wait for this matter to be resolved. Thank you

Hi Nicola - the conveyancer has provided one probate but no evidence of death re the second registered owner. They were contacted on 25th July
No need to apologise - hopefully the conveyancers involved can confirm/clarify things for you/the chain

Hi Adam, The conveyancers has advised me the below -
"This is to inform you that we have responded to all the requisitions received from the Land Registry. The matter is now pending with them." 

Can you please confirm if that is correct as I have lost all faith in what I am being told by them?

Hi Nicola - they responded to our last contact yesterday at 2.38pm. The response and case go back to the casework team to continue processing

HI Adam, The solicitor has advised the below -

"We confirm that we expedited the application at the Land Registry yesterday and have already responded to the requisitions we received. As soon as we receive a response, we will provide you with an update."

Can you please check to confirm if they have responded to the requisition that was raised on 4th August as they are saying that they have?

Hi Nicola - no reply but their comments don't match up with the timeline I can see
The application was expedited on 24th July (not 'yesterday') and processing started same day
We contacted them on the 24th and 25th July
They responded on 24th July re the fee element and on 1st August when they lodged a copy death certificate
We replied on 4th Aug to explain what was still required but nothing further has been received 
Taking what they have said literally I would agree that they have 'responded to the requisitions we received' but only in part
And our letter of the 4th August remains outstanding and that maybe the 'response' they were waiting for? But as yet they have not matched that with the case file?
Either way the ball is firmly in their court to respond in full to enable us to move matters forward 
I would suggest asking them to confirm if they have received our letter dated 4th August and if they say No let me know and I can get it reissued

Hi Adam, thank you so much for this, it is incredibly helpful. 
I think it is safe to say that myself and the gentleman handling the probate sale, have lost all confidence in the solicitor who is dealing with the application.
Is there any way that the gentleman who holds the probate can get in touch with the casework team directly to provide whatever is required? Or could he get a copy of the letters/emails to his solicitor so that he can ensure they are actioned without delay?

Hi Nicola - he can try but the application has been made by the conveyancer firm so we are very much tied to dealing with them as his legal rep for example. 
If he is dissatisfied with their efforts to date then he should escalate matters within the firm as appropriate and ask them for copies of the correspondence etc. In an effort to try and assist if you ask him to contact us directly then I can at least explain what remains outstanding and he can then seek to inform/assist the conveyancer as appropriate - Public guidance: dealing with land and property - GOV.UK - you can then ask him for the enquiry reference and share that with me here 
If he chose to dismiss them so that they no longer acted for him then we would need their written confirmation and that could delay matters further. I would recommend the escalation option as being the best one here

Hi Adam, Thank you so much for your help so far. We are really struggling with the conveyancer who has made this application and this matter is very likely to fall through if the buyer is not able to complete by the end of this month so we need this application concluded ASAP. 
The conveyancer advised that the copy of the grant of probate for Stephen James wasn't accepted as they had not sent a certified copy. The conveyancer holds an original copy so they should be able to confirm that to you and certified it before providing it. Can you please advise if a certified copy has been provided now and if there is anything else that is outstanding?
