Hi Adam, Please could you advise if there has been any further response from the conveyancer? The remortgage offer has been extended to 14/11 so hopefully the discharge can be processed before then.

Hi Thomas - nothing further as yet from the conveyancer. We last contacted them on the 26th after they had replied same day advising that their reply was insufficient

Thanks Adam, the conveyancers have advised they responded yesterday. Can you confirm if this is the case and advise the SLA for processing?

Hi Thomas - if they did then it's not showing as such with the application. Any online response would be added to the case in seconds so nothing showing since 26th Oct as stated

Hi Adam, 

I’ve had the following update from the solicitors: 

“I believe that the Land Registry has been provided with the required documentation.  The latest update on the pending application at the Land Registry suggests that notices have been served which are due to expire on 28 November but provides no detail about who has been served with notice and why.  I have contacted the Land Registry for an explanation.”


Are you able to confirm if the above is correct and shed any more light on these notices?

Hi Thomas - their reply, dated 7th Nov, was added to the case earlier today so they have replied now to the request.
Notices are served as a means of carrying out wider checks to insure against property fraud and to minimalise the risks of wrongful removal of certain entries.
IN this case we would be contacting the outgoing lender to confirm removal of their legal charge (mortgage). If they respond then things can be completed sooner. If they don;t then that won't happen until just after the 28th Nov
Most conveyancers would be aware of this process of required wider checks re removal of a legal charge in such cases

Thanks Adam, both the lender and solicitor seem to be baffled by this so just trying to get as much info as possible. To confirm will the notice have been sent directly to the outgoing lender (and not via the solicitor)? Also, how is this notice sent is it via email or post?

Thanks Adam. Sorry to bother you again but the outgoing lender seemed to have no idea how to deal with this notice. 

They said they have sent an email to kingstonuponhull.office@landregistry.gov.uk to confirm they have no objections to the discharge. 

Would this be a sufficient response?

Thomas - that's precisely what they should do. The notice is quite self-explanatory and clearly they have understood what to do if the lender has now responded positively

That response will be married up with the application and if all in order it can be completed

Hi Adam, 

Sorry to bother you again.  There is another issue on this title and another application should be being made to discharge the charge dated 04/2009. Please can you advise if that application has been lodged this morning?

This charge should’ve been discharged in 2011. Are you also able to see if an application was ever made in 2011 to remove this charge?

Thanks Adam, are you able to see far back enough to see if an application was ever made in 2011 that would subsequently rejected/withdrawn?

Thomas - I am and no such application was submitted n 2011. The only discharge we received was for the 1992 charge in favour of Barclays. Nothing for the 2009 one.
