SEV form, simultaneously processing alongside a Declaration of Trust/trust deed

Good afternoon, <br> <br> I want to check a few things before I submit my SEV form. <br> <br> I wish to submit the SEV form as we are all in agreement for the severance of joint tenant ownership.<br> <br> 1) do I need to submit a signed agreement document that states specific details such as percentage shares, with the SEV form - even if the form says No Evidence needed <br> <br> 2) How long is it taking for SEV applications to be processed at present<br> <br> 3) I want to instruct a solicitor to help me with a declaration of trust/trust deed, stating percentages of shares per owner amongst other details.<br> <br> Can this be done by the Solicitor while we are waiting for the SEV form to be processed, or will I have to wait for the SEV to complete or expedite the SEV application and when that is complete, then register the trust deed with a restriction reflecting the deed. <br> <br> I look forward to hearing from you<br> <br> kind regards<br> Sal<br>

Good Afternoon Sal - panel 7 of the form SEV offers you the options A, B and C. A is if you are both/all applying. B if not and your evidence of severance is an agreement/trust deed<br> Wait times are several months<br> You can still instruct a solicitor as appropriate. You don't have to wait for your form SEV with option A selected to be completed<br>

Just for clarification,<br> <br> If I submit the SEV form myself, and instruct a solicitor for the declaration of trust, it wouldn't be a conflict of interest for Solicitors, i.e they won't take on the instruction because I independently submitted the SEV.

Sal - I can't see how there could be any conflict of interest.<br> The declaration of trust will relate to your beneficial interests and is quite separate from the registered information we hold. For example if you enter into a declaration of trust you don't then have to apply to update the land register.<br> If the legal rep says you also need to update the land register then you can explain that you have done that/or will do that yourself. <br> Do check and confirm with your legal rep as well though
