Hi,

I am in the middle of buying a bunglaow and I am told the vendor has applied for expedited first registration. I am feeling the pressure at the moment from the buyer of my house who is is reaedy to complete and up against their own mortgage offer expiry. Are you able to give me an update on the status of the registration please?.

Hi Dale - received 17th January. Expedited on 21st. Processing started on 23rd. We needed more from the conveyancer and they have responded. Wider checks are underway with the Environment Agency as the property abuts a canal and those checks may not complete until after 12th February unless the recipient responds sooner. We can't hasten those checks

Wow, that was a quick response, thank you!.

Can you confirm if good root of title has been proven and confirmed? and is it just the environment agency checks to go?. It seems a little odd as there is no canal abutting the property that I have seen?

can you check that CL387718 is for the property plan attached?.

Dale - that's the correct property. The request for more information was only replied to recently but hopefully they have provided everything required.
Apologies as whilst I said canal the checks are triggered by land abutting canals, waterways, significant drains and other watercourses

Hi Adam,

Thanks for coming back to me and confirming the correct property, hopefully we get a speedy response from the environment agency (although I am still unaware of where this watercourse is, there's no sign of anything on the property and the recent searches didn't show anything either)

As far as the recently provided information as requested, can I contact you again tomorrow to see if the information has been reviewed by a case worker?. I'm keen to keep things moving along (with your help!), as I said before, the pressure is on!.

Dale - the application for first registration includes land that runs a long way south and up to/adjoining the river. Your plan only shows part of the larger land/property so assume you are buying a part only
You can post again for an update but in light of the wider checks I'd suggest perhaps leaving it a little linger before doing so

Ah, yes you are right it is a part only of a bigger package of land and property. I understand it now, as yes there is a river that runs along one of the fields, it's just not one that is part of what I'm buying (being part only).

I'll contact on Friday and ask for an update if you don't mind.

Has the extra information that was provided by the conveyancer been reviewed and is it satisifactory? Do we know if good root of title has been proven?.
Has there been any response from the environment agency yet?.
Is there anything else outstanding that I could chase up?.

Many thanks for looking into this, it's appreciated. I'm at a point where if this dosen't go through smoothly I am likely to loose my buyer, who is pressuring to complete.

Hi Dale - the wider check with the Environment Agency appears to be the outstanding point so nothing can be concluded until after 12th Feb unless they respond positive sooner
The conveyancer is up to date with what is happening also

Thank you for the update and apololgies for all my questions!.

Does that mean that the conveyancer has provided everything that was asked for and it is all in order with the only oustanding point being the environment agency?. Once the environment agency come back and all is ok with them will the registration complete?. I'm being pressured into giving my buyer a completion date as there mortgage offer is due to expire, but I can't give a date if there is a chance that this registraion gets held up or if the conveyancer can't provide what's needed. Do we know if good root of title has been proven based on what the conveyancer has provided?.

Hi Dale - all very valid Qs and all noted and appreciated. All I can confirm is as stated already. Everything else appears on the face of it to have been resolved
The registration will only be confirmed after the wider check completes so if you are being pressured for a completion date please speak to your conveyancer and respond as appropriate/they advise.
We can't be definitive re a completion date and can only confirm that the wider checks complete after the 12th if the EA don't respond before that date

Just looking for an update now that the time has passed for the Environment Agency. Is the case now being worked on and does it still appear that they have everything they need to complete the registration? Any idea of timescale?.

Hello,

Would you be able to confirm if the registration for CL387718 has completed. I keep being told by the solicitor that they are still waiting to hear from the Land Registry and as such we can't progress any further. However I have looked up the title on the search function and been able to download a copy of the register so I don't quite understand what they say they are waiting for.
