<p data-end=161 data-start=146>Good morning,</p> <p data-end=474 data-start=163>We are in the process of registering a new lease under an alternative mortgage refinancing arrangement. A TR1 transferring the property from our clients to the finance company was submitted a few days ago. We are now preparing to register the leaseback of the property from the finance company to our clients.</p> <p data-end=628 data-start=476>However, we are experiencing difficulties registering the leaseback because the landlord’s name has not yet been updated on the Land Registry records.</p> <p data-end=760 data-start=630>Could you please advise us on how best to proceed with registering the lease on the Land Registry portal in these circumstances?</p>

<p data-end=280 data-start=263>Dear Sir/Madam,</p> <p data-end=416 data-start=282>Thank you very much for your earlier advice. I would be grateful if you could kindly assist me further with the following situation.</p> <p data-end=438 data-start=418>By way of example:</p> <ul data-end=814 data-start=440> <li data-end=512 data-start=440> <p data-end=512 data-start=442>A and B were the registered proprietors (freeholders) of a property.</p> </li> <li data-end=555 data-start=513> <p data-end=555 data-start=515>A and B transferred the freehold to C.</p> </li> <li data-end=626 data-start=556> <p data-end=626 data-start=558>On the same day, C granted a leaseback of the property to A and B.</p> </li> <li data-end=814 data-start=627> <p data-end=814 data-start=629>The application to register the transfer of the freehold (eAP1) was submitted two days ago. The Land Registry records have not yet been updated to show C as the registered proprietor.</p> </li> </ul> <p data-end=1143 data-start=816>I now need to register the lease in favour of A and B. When preparing the lease registration, I entered A and B as tenants. However, because the Land Registry has not yet updated the title to show C as the freeholder, the portal still shows A and B as the proprietors and does not allow me to change the landlord’s name to C.</p> <p data-end=1291 data-start=1145>If I proceed on the portal as it stands, the application would appear to show A and B as both landlord and tenant, which is obviously incorrect.</p> <p data-end=1319 data-start=1293>Could you please advise:</p> <ul data-end=1716 data-start=1321> <li data-end=1507 data-start=1321> <p data-end=1507 data-start=1323>Should I leave the landlord details as they currently appear on the register (A and B) and rely on the system to update automatically once the freehold transfer is registered; <strong data-end=1505 data-start=1499>or</strong></p> </li> <li data-end=1716 data-start=1508> <p data-end=1716 data-start=1510>Should I take additional steps (such as submitting the lease application linked to the pending transfer application, or providing further evidence) to ensure the lease registration reflects C as landlord?</p> </li> </ul> <p data-end=1784 data-start=1718>Your guidance on the correct approach would be much appreciated.</p>
