Hi, we are dealing with new freehold covenants being agreed between neighbours about overhangs and projections couple of queries: 1. We are acting for one party does the other unrepresented party need ID1 as no money is changing hands. 2. Is a plan necessary to go along with the document as my predecessor did not arrange one. 3. When the deed benefit is registered on our client title, will there be automatic noting of the burden on the neighbouring title?

Hi Amit - a deed of covenant does not fall into the category of applications requiring evidence of identity - see PG 67 for guidance. If the deed/covenants need to refer to a plan to explain what the deed/covenant means then Yes. But if not then a p[lan is not needed. If you apply to note the Deed against both titles then yes.
