Hello! I am writing as I am in the process of purchasing a property. But there is a small section of garden that hadn’t yet been registered (so cannot be sold). The seller’s solicitors advised that they had sent in the application but had no timelines. They have now said that they have expedited it, but again no timelines.

the title deed is BM472202. Is there any way to finding out how that application is going?

Hello Hannah - it's still with us and looks like we were waiting on a variety of information from the conveyancer, which they have it seems now supplied. Hopefully it can be progressed quickly from here but may still be a week or so away from that. Make a note to post again next week and we can check for an update

Hi Hannah - so they replied which triggered next steps. We still need more information from them and contacted them yesterday and we will also need to arrange a survey/site visit as well. 
So we need a further response from them and then the survey can be arranged. Hopefully they can provide the amended information to enable matters to progress but there is still a way to go before the registration can be completed

I just want to check - if they respond, and then the survey can go ahead, what kind of timeline would we be looking at? My mortgage offer runs out in just over a month so I want to manage my expectations.

Hi Hannah - it's very difficult to be precise re such matters but in my experience there tend to be two stages to resolving matters once they have provided the requested additional information
The site visit is carried out by Ordnance Survey and they generally do that within 2 weeks of our request. They then report back and the case and their report are reviewed/compared
The final stage, if the comparison all matches, can be wider checks with affected/neighbouring landowners to see if anyone objects to what's going to be done re the registered titles. That can add 3 weeks to the timescale but again could be longer or such checks aren't needed at all.
So my advice would be to a) encourage the conveyancer to respond in full asap and b) have a word with your lender to see if an extension can be given re the offer 
Next check would then be after the OS visit and report and the property owner should be aware when OS are coming/have been

Hi Andy, this all sounds complicated but at least it is moving forwards. I have encouraged the seller’s solicitor, and will speak with my mortgage lender about the possibility of extending. 

As a lover of all things map related the OS visit sounds great. As a buyer of a property, less so.

My conveyancer has said that I should definitely try to amalgamate the titles once this process is over, as it is complicated and messy. Is that something I could do to future proof, even if it took a long time?

Hi Hannah - amalgamation will only be possible if the two titles are of the same class/tenure. I suspect, but don;t know as yet, that the extra land will have possessory title so amalgamation won't be possible at the present time. In 12 years yes when it can be upgraded to absolute just like the main property - best check with your conveyancer as they may have some other reason for offering the advice they have

Ah ok! It’s all very interesting.

Can you see whether they have now responded to the questions please?

Will the current owner (seller) of the property have to book the Ordnance Survey visit or will that be Land Registry?

We ask OS to visit and notify the registered owner. That won;t happen until the request issued is resolved

I chased everyone and have been told that the solicitor has now responded to the enquiries. Please could you check if everything has now been received or if anything is outstanding?

Hi Hannah - nothing showing as having been received as yet.
I should stress that even once they have replied a site visit/survey will then be required providing what they supply is sufficient/in order

Hi Hannah - they replied on 28th with new paperwork so that will mean the case is reviewed again to see if all is now in order. If it is then next stage is a site visit/survey
