Hopefully the survey/site visit happens quickly and everyone is sensible (there are 4 titles for a small garden, and this new - 4th- one is for some sections inside the existing borders that were just missed out before). My mortgage offer cannot be extended so I have 4 weeks for it all to be sorted.

Hi Adam, I was excited too soon. It turns out there was a separate ‘transfer of part’ application for adverse possession on a different title. From what I can see from the other titles, there were squares in different places that don’t make sense and have ended up in one another’s gardens. So BM474202 was being done at the same time. I am hoping that the OS visit will cover this as well because it is about 1 or 2M square in the middle of the garden. But I think the neighbour has been contacted. 
Do you think that this is now a long process? Do they have to expedite it or has that happened at the same time as the other one?

Hi Hannah - that's a shame and apologies as I was unaware of a second application.
That one has also been processed and was being done alongside the one now completed. However it's needs are different and it is still pending whilst wider checks are completed. Those checks, started on 11th September, include contacting the current owner, Mr Pickles, and his mortgage lender. They are given time to respond and that time runs out on the 11th of December.
The only way that registration will be completed sooner is if we get positive responses from both

Hi Adam,
I’m just checking (and I have emailed my solicitor too)- I have been told that there is now ‘evidence’ that this will be sorted on December 11, and asked if I would be willing to go ahead with the purchase because of that.

To me it seems that if there were evidence that the registration would definitely be done on December 11, then registration could be done before then because December 11 is just the deadline to receive a response/null response. The best evidence would be the neighbour and their lender responding that they don’t have a problem with the application. But I don’t want to make an assumption. 

My question is whether in your knowledge there could be any such evidence or whether any responses have been received?

Hi Hannah - I suspect they are just trying to prepare the ground so that you can forge ahead from 11th Dec onwards
We have had a reply from the lender but asking for more information. I will check with the casework team for an update as this can often extend the time allowed for them to respond

Hi Adam,

Thank you for checking. It will be really good to understand the timelines as I have to decide what to do/whether to start looking for a different property. 
 

They asked me whether I would go ahead before it is sorted based on the ‘evidence’ that they have that it will definitely be done on December 11. But it doesn’t sound cut and dried that it will come through in the affirmative by December 11. I think they were just trying to keep momentum as you say, but I do want to make sure everything is legitimate.

I was just wondering whether the casework team have an update at all? My mortgage offer has been extended a small amount but not until December, and  if the lender has been given additional time on top of that to respond I have to figure out what to do.

Hi Hannah - extra time can be given if Qs are raised or the notices are undelivered for example. That hasn't happened as yet.

Hi Adam,

Ah ok! I thought you said last week that the lender had responded with some questions. You said that you would check with the casework team for an update as this can often extend the time allowed for them to respond. That’s why I was asking 😊

Hi Hannah - the lender asked for more information re their account so that they could match the correspondence accurately. They still have until 11th Dec to respond

Hi Adam,

I hope all is well! I’m still getting used to the dark evenings 😁

I’m just wondering whether there have been any responses to the notices? The seller’s solicitor suggested that there should be but we haven’t seen anything so I thought I would check.

The neighbour (and their lender) was given until December 11 to respond on this title issue. Can you see whether it is going ahead or not?

Hi Hannah - you are a tad early as they have until today to respond. I can't see any replies as yet so hopefully there won;t be and things can proceed in next day or two.
