Good day.

I have a neighbour disputes with my neighbour who trespassing my property and destroying my belongings while they keep harassing us.  After the consultation with solicitor and surveyor, they need the title plan and title register.  Since my house is a new-built, I have contacted the conveyancing solicitor two weeks ago for expediting the land registration, but haven't received the documents yet.  Just wondering when can I receive those documents since we would like to take the legal action to stop my neighbour's invasion and harassment.

Cheers

Good day Hollie - there are lengthy delays with 'new build' registrations and it can be on average as long as 14+ months after the application has been submitted before it's processed
A few things to therefore consider - the key document may be the actual Plot transfer itself and not the register/title plan as that will show the plot's extent and also the rights and more entered into. The register will simply refer to that plot Transfer and the title plan will simply show the registered extent.
Secondly if the neighbour's title has been registered then their registered information may be relevant
And thirdly if there's a need for urgency because your solicitor is unable to take legal action without the title being registered then they should request expedition to shorten the remaining timeframe
