Hi

just seeing if you can help here. A property we are purchasing is at a big risk of falling through due to delays in completion of the adverse land possession claim. The property is 39 Redhill court Barnsley s751hf. The mortgage offer we have on the house which has already been extended expires next Friday, however the buyer of my current property needs confirmation today that things will be completed with land registry so they have time to complete the process for the house completion by next Friday. So it already looks like we are going to miss the mortgage expiration date. The main issue is the risk to the chain as I fear it will fully collapse which is causing a great deal of stress.

the application has already been expedited with LR. Please could you tell me if the application is in process, and any potential rough time frames just so I can manage the chains expectations here. Also if you can produce this information has there been any issues or objections to the land claim? This information will help everyone in the chain and reduce The risk of collapse.

kind regards

Hi Jonathan - the application is still with us as there is ongoing correspondence with affected parties, notably from the Council. That remains outstanding and the case is with our lawyers to consider next steps.
I can flag it with the casework team re the additional urgency but please do rely on the conveyancers involved to manage expectations re both the chain and the mortgage offer expiry
SYK722725

Hi Adam

sorry I am confused by this now as we have contacted the council today who have informed us they responded to the land registry request on the 12th of November and there has been no further correspondence since? Please can you confirm this has been received and acted upon. Nobody involved can seem to get any reliable information as being told different things from different people. The conveyancer is also not getting much information so we are all at a loss as to where things stand, how long likely to take etc.

kind regards

Hi Jonathan - the council have been in touch and that is why the application remains 'open' and with our lawyers to decide next steps as appropriate.
I posted that there was 'ongoing correspondence' and until our lawyers decide on next steps/more correspondence with the council/applicant or others, the case remains 'open'
There is no information to share with any of the parties directly involved until those next steps are confirmed.
I have flagged the case with the relevant support team to escalate matters and that should result in next steps being confirmed next week - who is then contacted will depend on the outcome of the review by our lawyers.
SYK722725
Hi Jonathan - we have written to the council and clarified the registration position and given them until the 15th December to respond with more information/counter argument to the position we have taken
I can't share the specific details with you but as things stand next steps seem unlikely to be taken until after the 15th December
By all means post again after that date and we can check for a further update.
SYK722725

Hi Jonathan - too early for anything to have moved forward today. I'll make a note to check again through the day/tomorrow to see what's happening and will post if anything to share
The nature of the application and the previous corres suggests to me that things might not be concluded until Thursday/Friday at best - it's a manual process and whilst a deadline of the 15th was provided the casework team need to check contacts through a variety of channels and review matters again and that often takes time
SYK722725

Hi Adam

sorry to check in again regarding this. Just seeing if things have moved on at all. People in the chain are pushing for more information so just wanted to check again. Also just so I can manage expectations of everyone, will the casework team be working over the Xmas period or is this likely to be pushed back to the new year if not resolved before tomorrow?

thanks

Hi Jonathan - Just to update you the application was completed a short time ago this morning. Confirmation of the registration has been issued electronically to the conveyancers who submitted it.
Hope this helps.
