Good morning, I am the buyer of a property that is currently affected by a boundary line issue. Our entire property chain is at risk of collapsing if this matter cannot be resolved urgently. The application reference is TA1C43D. We understand that a notice served by the Land Registry expired on 29 June. However, we have now been informed that a further notice has been issued, with an expiry date of 22 July. Could you please explain why this additional notice has been served? We would also appreciate clarification on whether any further notices are expected after this, or if this will be the final one. We urgently need an update, as we have been unable to obtain any information about the progress of the application. Our buyer has advised that they will withdraw their offer today unless we can provide a clear timeline for resolution. We would be very grateful for any information you can provide as soon as possible. Thank you for your assistance.

Good Morning Agata - your understanding is correct and the additional notice has been served as we are required to do so. We can't confirm or deny what might be required in the future whilst this further Notice remains outstanding. The conveyancer is aware. The only clear timeline you can offer at this stage is what you are already aware of and understand, namely that as things currently stand matters are unlikely to be resolved until shortly after the 22nd July providing no other issues arise. Sorry, as that may read as slightly harsh but they are the current facts we can share with you.

Good morning Adam. Thank you for your reply. Could I please ask whether the Land Registry received any objections in response to the previous notice, resulting in this further notice being issued, or is this simply part of the standard legal process that must be followed? We are trying to understand the nature of the situation and whether this is a routine procedural step, or whether there are any specific issues or concerns affecting the application.

Good Afternoon Agata - the second Notice was served separately and not in relation to the first notice. It's part of the registration process we are required to follow. It is routine

Hi Adam, Thank you for your reply. I’m so sorry for all the questions, but we’re desperate to protect this chain. If no objections are received, or if everyone who has been served with the notice gives their consent, does that mean the registration will be successful and completed shortly after 22nd July? Hi Agata - no apology needed as I know from experience how stressful such scenarios can be especially when you are not used to or aware of what's specifically involved and/or not getting too much info from others involved. If everything is ok after 22nd July then yes.

Agata - Your legal adviser are the ones to confirm what happens in law re such scenarios and how the registration process works in relation to the legal situation. I don't mean that as a rebuke to your posting here but it's an important tenet to understand re such matters as it's not for us to guide people through the legal complexities involved and we must be very mindful of that fact. Everything crossed at my end that things progress in the way that you hope and the legal reps expect.
