We have a client who took a new lease from the same landlord while the old lease was still running. We understand that this is surrender by operation of law. Can we simply with an an AP1 just send in the new lease as evidence (a separate application has been made to register the new lease) for land registry to close the title and remove any note on the freehold or will we also need a statement of truth from our client (the tenant). It is same premises and same parties on both.
