HI all

Thanks for looking into this again :-)

I have has updates from my solicitors and it's been given Possessory title

Questions that's going to be asked is " Given the seller has owned the property for a significantly long period, absolute title should have been granted. On that basis, we will go back to the seller’s solicitor to get confirmation as to why the Land Registry did not grant absolute title and whether they can upgrade the title "

Can the title be upgraded? Would save a lot of hassle and then i can sign contracts etc and move :-) (All packed up and living out of boxes atm)

Hi Steven - whilst it can in my experience 99% of the time it won't be unless they are able to provide some form of documentary (deeds) evidence to prove title. 
The law is a complex one re such matters but essentially any claim (without deeds) relies on a period of use/occupation. They've covered that so we can register the claimed land. But from a registration perspective we too have to rely on a period of registration to pass before it can be upgraded to absolute.
The fact that the seller claims to have owned it for a significantly long period only covers the first part of the claim. Once they have owned the possessory title for another length of time the upgrade can occur.
I'd suggest speaking to your conveyancer with regards options such as an indemnity policy re the 'risk' involved re a possessory title as appropriate but much may now depend on the mortgage involved and the lender's view also

I have checked with Talbots and they have said that they have queried the title with the land registry and wait to hear back from them."

Can some one contact talbots please and update them (Sorry to be a pain)

Steven - there's no outstanding enquiry re WM347881 (cancelled title) or MM189554 (possessory title) so nothing to contact Talbots about.

They contacted us on the 6th and we replied on the 12th and the position re possessory title has been repeated
