I instructed my solicitor in March to add two trustees, my adult children to my title deed. Have not heard anything and when I contact him this week. He told me he had submitted an application to remove a restriction, not sure what he meant by that as have already removed my deceased husband from the title deed. Although we have provided id and death certificate, we were not given any TRI form to fill, sign and witness. Have asked for clarication, no response yet. It’s BM50705. Could you please check the process of the application if possible? Thanks

Marie - application submitted on 22nd April to cancel the form A/joint ownership restriction. No Transfer from you to yourself and adult children. The casework team will contact the conveyancer when processing starts but that's unlikely to be for several months as we have a backlog of this type of work. If you do decide to transfer the legal ownership that can be done and submitted. The current application can be left to proceed or can be cancelled as appropriate. Your conveyancer can advise

Thank you, was not aware he needed to remove restriction before adding trustees. I thought filling form TRI is enough. Now I am aware it will take months, can I just leave the process with my solicitor or do I need to ask him to chase? How long do I need to wait. Thanks

Marie - the form A restriction wouldn't stop your transfer. And how long it takes won't delay you transferring the ownership now. So there's no need to wait

I understand there was no need to remove the restrictions. Was not aware my solicitor was going to do it. Is there any benefits of removing the restrictions? Have asked him to explain his action. Pl can you advice what’s the next step. It is a simple request adding two trustees to my title deed. He seems to have messed it up. Thanks

Marie - you need to rely on your conveyancer re what's needed in these circumstances as adding your children as trustees has a wider impact than simply updating the register. And I suspect if you do transfer it into your 3 names you'll want a form A restriction to protect the beneficial interests/trust involved The other restriction also needs to be considered if you do want to transfer the ownership. Check with your conveyancer as to what's best and why they have made the application they have

This is the response I got from my solicitor. The plan would be to temporarily remove the Restriction to allow the transfer into joint names and then re-enter it with the application to add names. I thought it was not necessary to remove the restrictions to just add two trustees. He is getting it more complicated and taking the lengthy and costly route? Am I wrong to think he could just complete TRI form and the two trustees name? Thanks

Marie - I have responded to your further post in the absence of my colleague. We would not be aware of what is happening beyond of the registration process so it would not be appropriate to comment on what your solicitor is proposing and why. We would suggest you discuss your thoughts with them.
