Following my earlier telephone call could you advise if the reply from the Council (sent via email early yesterday afternoon) to the B16-1 notification regarding this application has now been found?

If not, could I ask that you make every effort to locate it urgently and also process the application urgently.

There are currently two property transactions pending this application with all parties in a position to complete.


Once processed could I also ask how long before your public websites and records are updated with the new title plan?

Huw - information provided by the council was added to the case yesterday. And it's been referred to a senior technician to consider next steps as appropriate. It's expedite status will ensure that happens asap
Once completed then the registered information would be available online immediately

Thank you for your prompt response.

The reason I reached out was that when I telephoned this morning, I was informed that the information from the Council had not yet been attached to the file. However, your message confirms that it was added yesterday. I’m not sure why I was misinformed, but I’m pleased to hear it is now with the senior technician for review.

I appreciate the expedited status, but as I’ve mentioned previously, there are two property transactions currently waiting on this application. The additional delay caused by unnecessarily notifying the Council—when Land Registry already had an official letter from them outlining their stance on the land in question—has already resulted in unnecessary delays.

Given the urgency of the situation, could I ask that this be dealt with immediately as a matter of urgency? If there is anything further required to progress this without delay, please do let me know. I would also appreciate confirmation once the application has been processed.

Good afternoon Adam,
I wanted to follow up on my request yesterday for title number CYM899518 to be processed immediately now that the local council has responded following the notice served.  As everything required is now in place, I would appreciate confirmation that my application can now be processed and is being actioned without further delay.

Please let me know if anything else is needed to move forward and complete the processing to register the land and allow the two pending sales to be completed and progress on a third sale not to be affected by this matter.  I'd be grateful for an update at your earliest convenience, hopefully with positive news.

Good morning Adam.
Unfortunately it appears the DS3 discharge submitted by Nationwide on 8 November 2024 has not been fully applied to the new title plan.

When the title plan was updated as per yesterday's messages, the hedge land was added to the title. However, the mortgage charge from 2020 was incorrectly assumed to apply to this newly added land, despite the DS3 already releasing it.

Please could I ask that you immediately look at this omission and correct urgently?  This mistake is holding up both sale transactions and I would appreciate a clear timeline for resolution.
 

Additionally, please confirm once the correction has been completed.

Let me know if anything further is required to assist in resolving this.

Huw - I'll flag with the casework team but if an error has been made I would normally expect the conveyancer to contact us through their normal channel
Happy to ask the casework team to check and advise and see what they have to say though

My solicitor has indicated they will also be reaching out to you directly, but this may inevitably take more time. However, given the urgency of the situation and the fact that the new title plan was only released yesterday (with this mistake), I am reaching out via this channel to hopefully ensure this matter is resolved immediately and urgently. To repeat, the error is impacting both sale transactions, and I would appreciate your assistance in correcting the mistake without delay.

Please let me know if there’s anything else I can do to support this process, and I would greatly appreciate an update from the casework team as soon as possible.

Huw - I'm hopeful that the casework team can make the amendment without further help but thank you for the offer.
It's unfortunate that the form DS3 and application to register same pre-dated the one to claim the land

Hi Adam,
I've followed up with my Solicitor who has informed me that the buyers solicitor has said they are awaiting results of their Land Registry search.
Could you confirm the dates land registry received the search query (I'm assuming OS1, but could it be OS2?) and also the date when Land Registry responded please?
