You helped us with us last year when we were going through the purchase of this property.
We bought the property on the 13 August 2024 and our solicitor requested the Freehold and Leasehold be updated and the restriction on  the Freehold removed.
They sent all the details and the RX4 on the 15 August 2024.
We were sent details this week from our solicitor that showed the Freehold had been updated but the restriction not removed and the leasehold not updated at all.
I don’t know where the fault line laid with this but we just need things amending.
Our solicitor has re requested this and resent the RX4  and asked for it to be looked at urgently
Obviously we’re really concerned that the old restriction has not been moved.
Can you check that all this has now been received and likely timeframes.

Hi Roger - they have just submitted an application to update GM187604 re the 2024 Transfer. They have done the same re the RX1 and title GM564496. Both submitted yesterday
They have not as yet requested expedition - Request an expedite - GOV.UK

Roger - it is likely to wait 4+ months before being processed. I can't find any request for expedition submitted against either title.
They must submit them first and request expedition second and as a separate request. 
You haven't stated what the urgency is in your post so if it's simply because the conveyancer didn't apply when they should then we wouldn't expedite. The transfer/RX1 applications are both now protected and so is your ownership

There is no urgency in that sense.
It's just that the transfers that were requested in August 2024 were not done correctly. We now have our names in the freehold title but a restriction relating to the previous owners still on, plus the leasehold was missed. We just need assurances this will all be put right as it's a worry that if we wanted to sell the property we couldn't. ( We don't have any plans to!) It's should we go to the back of the queue again if it was originally missed?

Hi Roger - noted and appreciated. The original applications were completed expeditiously and it seems that it was a conveyancer's 'miss'.
Any assurances as to whether they have now applied correctly to 'put it right' should come from the conveyancer
I will flag with the casework team though and ask them to hasten the progress so that the wait is not as long as it would normally be. That way at least a HMLR assurance might be forthcoming as well once the applications have been processed

Sorry Adam, one last question. Our solicitor said they uploaded the RX4 to remove the restriction. You mention an RX1, is that the actual restriction document and the RX4 removes it? Just want to make sure they have sent the correct document.

I did check with our solicitor who have confirmed they did send the RX4 with the original application in August 24 and it seemed it was missed when they updatedour title. All now resubmitted but not sure if this helps it gets looked at sooner. Many Thanks Roger

Hi Roger - the application against GM564496 included an e-AP1 and form RX4. That has now been processed but rejected as they have applied using the wrong form. Their application should be in form RX3 due to the nature of the restriction they are seeking to remove. Such a restriction cannot be withdrawn and has to be cancelled hence form RX3 is required 
This appears to have been explained back in December when the previous application against that title was being processed
The application against GM187604 has been partially processed but is incomplete. The casework team have contacted the conveyancer to explain why and what more is required
Hopefully your conveyancer can confirm the above and submit a correct application re the first title and provide a response re the second title.
I'm sure they will be able to put both matters right and feel free to let me know when they have done so and I can flag again with the casework team as appropriate
