Delays at Land Registry preventing me from paying off a Bridging Loan

Due to personal reasons I recently had to relocate. I found an excellent house to buy and my existing house is in good condition and in a sought-after location.<br> A Bridging Loan is always a risky choice but the new house was less expensive than the current one so I could afford a few months of a costly loan.<br> I put my existing house on the market and moved into the new house on May 3rd.  The solicitor notified the Land Registry of the Legal Charge.<br> Within a few weeks I had an offer from a 1st time buyer and the conveyancing went well.Everything is now in place except for the Land Registry Search which shows the Charge on my existing home as 'Pending'. This is preventing the buyer's Solicitor from Reporting back to their client and exchanging contracts.<br> I knew that a Bridging Loan might be risky but it never occurred to me that the Land Registry would be the cause of the delay.<br> It's now costing me around £1,000 a week in compound interest plus double Council Tax, double home insurance etc.. The solicitor has expedited the application but all they get back from the Land Registry is:<br> 'I am sorry to report that cases are taking longer to process than we would like at the moment. We will aim to process your application as soon as possible. We have every application logged and know the importance of your application to you and your clients.'<br> I'm over 70. Losing £1,000 a week from the proceeds of downsizing my home is not just a financial disaster, it's also very stressful.<br> If anyone reading this can suggest a good way to deal with the problem I'd much appreciate it.<br>

I have removed the address for privacy reasons<br> The application hasn't been expedited and the replies to date have stated what they have because the conveyancer has queried progress - the wording you have quoted is from a generic response re progress only<br> We ask anyone requesting expedition to use a dedicated channel - <a href="https://www.gov.uk/guidance/request-an-expedite">Request an expedite - GOV.UK</a> <br> Unfortunately the conveyancer used their secure portal to add the request to the case but that won't be seen until processing actually starts<br> I'll ask the casework team to expedite it now and processing will start asap. Everything then hinges on it being in order<br> Processing the application is not my responsibility but I have some concerns with regards the application as lodged and it might be worth speaking to your conveyancer to clarify what they have applied for - you don't have to and can wait for the casework team to process it/get in touch with them direct though if you prefer<br> You have posted "....the Land Registry Search which shows the Charge on my existing home as 'Pending'." when their application is to register a restriction, not a charge.<br> NGL379716

I'd appreciate all the help I can have from your side because I struggle with my conveyancers. Here is a message from me and the contradicting reply from them dated 24th.<br> <br> (Q) "...this is now the only remaining issue. Has this been expedited? Request for expediting is dependent upon a financial loss and my bridging loan is costing me over a thousand pounds a week."<br> (A)  "The application has been expedited, and I have given the Land Registry several nudges, only to get the same response."<br> <br> I don't have any mortgage as such on either of the two houses. Due to an issue with Spray Foam on the house I am buying the lenders insisted on using both properties to secure the loan. Hence the involvement of the Land registry, I guess that counts as a restriction to ensure that the lender gets priority over the funds.<br> <br>

Mervyn - the case has been partially processed but as I suspected the casework team have gone back to the conveyancer with a preliminary request. <br> You'll need to speak to your conveyancer to confirm and to clarify what they intend to do next to resolve the situation and doubtless they will need to work with your lender and you to do so as quickly as possible<br> NGL379716

Thanks for your very quick responses. Can you possibly give me some idea of the discrepancy with the application? I can forward that to the loan broker so that he can keep an eye on what is going on. I'm not allowed to deal directly with the lender.

Mervyn - I can't share specific details but as posted their application is flawed/incomplete. They have applied for a restriction that refers to a legal charge (mortgage) but the latter is not actually registered on the title against which they have applied.<br> They need to consider what it is they are trying to protect and how that can be achieved <br> I would suggest that the broker is made aware that the application is flawed and needs to be reconsidered<br> NGL379716

Good morning Adam - I have received the following from my solicitors: <br> In any event, the application has now been picked up, and we have today responded to all requisitions raised by the Land Registry. <br> Can you please check to see if you have received the necessary information to proceed?
