Dawn - wait times are lengthy so there will be a significant wait, perhaps around 4 months, before processing starts. Mr R will be contacted when it starts/is completed as appropriate<br> There should be no reason to worry about how long the wait is likely to be&#160;<br> MAN290038

Dawn - understood but what's the urgency re updating the register re the death itself?<br> You've never explained or mentioned why and a death is factual so can be proven at any time as far as the property is concerned.<br> Apologies as I know that may read as being very harsh but updating the register re a death has no direct link to a new kitchen for example<br> But if the property is being sold or remortgaged and the buyer/lender won't complete until it is updated - that's a reason to request expedition -&#160;<a href="https://www.gov.uk/guidance/request-an-expedite">Request an expedite - GOV.UK</a><br> &#160;

Sorry Adam for not explaining.&#160;<br> So my partner is getting a small mortgage to pay for the work on the house ( he has no mortgage now)<br> The people that have been doing the financial side didn't check the deeds when he first applied for the mortgage.&#160;<br> The fact that his deceased wife's name is still on the deeds makes a difference to him getting the motgage.<br> <br> Hope this makes sense&#160;<br> Thanks&#160;<br> &#160;

Dawn - no apology needed as I guessed there must be something extra behind the thread but for privacy reasons I didn't wish to pry.....until you opened the door to it so to speak<br> I'll flag with colleagues to expedite it but do now also need to explain that even with the register updated he's not going to be able to remortgage as there is a restriction on the title that also needs to be dealt with - removed I suspect&#160;<br> Was he/you aware and have the financial people not mentioned it?<br> It's a form A (joint ownership) restriction and often referred to when people own a property as 'tenants in common' and they severed their joint tenancy in 2021 and applied for that form A restriction <p>An application to cancel a Form A/joint ownership restriction must be made in&#160;<a href="https://www.gov.uk/government/publications/cancel-a-restriction-registration-rx3">Form RX3</a>&#160;together with evidence to show that the restriction is no longer required. Thanks for this Adam. The financial people /solicitors have been absolutely useless to be honest .It's all extremely confusing so he's going to speak to a solicitor friend of his to see what's going on.<br> Am I right in assuming that once the relevant forms are filled in and sent in to yourselves that this os going to take a good while to sort out?&#160;<br> <br> Thanks again for your help&#160;

hello again<br> my partner and his wife (now deceased) changed the tenancy from joint tenants to tenants in law and a restriction a was added, im assuming because they had 3 children together and wanted to make sure that on her death that half of the house would be theirs. in this case is it possible to have this restriction removed to be able to get a small mortgage on the house? would an arrangement need to be made via a solicitor?<br> <br> thankyou for your patience

Hello Dawn - I would suggest your partner get legal advice on the matter.&#160; It would not be appropriate for us to tell you if it is possible and appropriate to remove the restriction.&#160;
