I just wanted to mention that there has already been three surveys carried out in the last 3 years. I find it hard to see what another survey is going to show that the previous three survey haven’t already revealed.
Having tried to negotiate a resolution to this with my neighbours, through solicitors correspondence over a period of two and a half years, I am still not clear what my neighbours legal objections are. Each challenge my neighbours solicitor put forward had no merit but yet they still refused to agree to rectify the title deeds, leaving me with no other option than to make this current application for adverse possession.
i purchased this small piece of land over thirty years ago and use it daily. The application in my view and the views of multiple legal experts fulfils all the legal requirements for adverse possession.
I really urge someone to at least serve my neighbours with the papers and let us find out what their legal challenge/s are so that these challenges can be dismissed or the process can move forward somehow.
My apologies for sounding frustrated but this issue has been ongoing for over three years now and any hope of mediation that my solicitor tried to arrange was sabotaged, leaving the only route left, apart from submitting to my neighbours demands, being this application which again appears to be dragging on and on.
