Adverse possession application identification number is: MF84E46.  
This application was submitted April 2025 by my solicitor.
A request to expedite the application made by my solicitor, has been approved and I understand was passed to the processing team at the Land Registry on 8th August 2025, to be dealt with as priority.
Can you tell me whether my neighbour has been served with the application details yet?

SMW WMS - the application is currently with a senior officer to consider next steps inc whether a site visit/survey is required. The neighbour has not been served details as yet

Thank you for your speedy reply.  If the decision is to arrange a site visit/survey, who is responsible for funding that?
Is it likely to be days, weeks or months before a decision is made?

Dear SMW WMS - the site visit is funded as part of the registration process. 
Days/Weeks to go at present but we need to see what the senior officer decides re next steps before remaining timescales become clearer

Dear Adam,

I write to ask two further questions:

1.   Has the senior officer made a decision yet?
2.   Can the papers which have been submitted by my solicitor, be sent to my neighbours?  At least then we can find out what objections my neighbours are making and the senior officer/team would be in a better position to make their decision.

Dear SMW WMS - 1. Not as yet but I have escalated it with the casework team to ask them to ask for the referral to be dealt with asap
2. They should make a request as appropriate - Contact HM Land Registry - GOV.UK 
I should stress though that there's been no correspondence/objections as yet as next steps, inc a survey, have not yet been taken

Thank  you for your speedy response.

I just wanted to mention that there has already been three surveys carried out in the last 3 years.  I find it hard to see what another survey is going to show that the previous three survey haven’t already revealed.  


Having tried to negotiate a resolution to this with my neighbours,  through solicitors correspondence over a period of two and a half years, I am still not clear what my neighbours legal objections are.  Each challenge my neighbours solicitor put forward had no merit but yet they still refused to agree to rectify the title deeds, leaving me with no other option than to make this current application for adverse possession.

i purchased this small piece of land over thirty years ago and use it daily.  The application in my view and the views of multiple legal experts fulfils all the legal requirements for adverse possession.  
 

I really urge someone to at least serve my neighbours with the papers and let us find out what their legal challenge/s are so that these challenges can be dismissed or the process can move forward somehow.

My apologies for sounding frustrated but this issue has been ongoing for over three years now and any hope of mediation that my solicitor tried to arrange was sabotaged, leaving the only route left, apart from submitting to my neighbours demands, being this application which again appears to be dragging on and on.

Dear SMW WMS - all noted and appreciated and I am sorry to read of the issues faced. Sadly there's nothing we can do via the forum re a specific application and the issues you refer to. If you have concerns as to how matters are being progressed/processed then I would suggest raising them via the contact form so that the casework team can consider and respond as appropriate. The forum is aimed at dealing with general matters and explanations and not case-specific matters/issues that should be dealt with by the casework team dealing with the case

Dear SMW WMS - the casework team have contacted the conveyancer to explain the position and what happens next. The conveyancer will need to consider and respond as appropriate and you should contact them to confirmand to discuss options

I received your posting but I don’t understand the content.   I do not have a conveyancer, I do not have this property up for sale.  Are you referring to my solicitor who made the initial application on my behalf?

Dear Adam

firstly I wish to thank you for getting things moving with this case, albeit not favourable for me at this stage, I do appreciate your actions.

secondly can you inform the casework team the following:

1. The chronological detail in their reply, which I assume they have based their decision, is not correct and my solicitor will be making a response accordingly

2, I have been informed that my solicitor is now on leave which shortens the response time available as stated in the reply

3. Please request that the casework team do not cancel this application/close the case at this time, we will be responding hopefully within the month timeframe given.

Dear SMW WMS - noted and appreciated although this needs to be submitted formally, ideally by the firm acting for you and who submitted the application/are dealing with the correspondence
I would suggest that you ask the firm to respond in kind and/or you use our contact form to submit the information you mention and ask for more time to respond - Public guidance: dealing with land and property - GOV.UK

Dear Adam, Since our last contact several months ago, I understand that my neighbours have been notified of the adverse possession application. The 65 day period for them to respond expired today. I am writing to enquire whether my neighbours have submitted a counter notice and/or objections to the application, what happens now? I look forward to receiving your reply and thank you in anticipation.

Dear SMW WMS - they can request copies as appropriate. I'd suggest speaking to your conveyancer and they will know how the process works and go from there.
