<span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">Ok, this is a bit complicated and unusual.. My grandad left me an unregistered house with a very large garden about 3/4 of an acre. I now need to register it. The pre registration deeds [I have not examined them as yet] will identify the land concerned, so no problem there..</span></span></span><br> <br> <span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">Now, my grandads mum [she left the house to my grandad], many years ago, let someone use a large part of the garden.</span></span></span><br> <span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">Later still, the person she let use it, built a house on it..<br> <br> My grandad told her to put a stop to it, but she apparently did not &quot;like to make a fuss&quot;</span></span></span><br> <br> <span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">The part in question is still not registered, so the people in possession of it, have obviously not made a claim for adverse possession or otherwise tried to register it. I also know that permission will block any claim for adverse possession, BUT, that acquiescence does not amount to permission..</span></span></span><br> <br> <span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">Now, my question..</span></span></span><br> <br> <span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">When I apply for first registration, do I just apply to register our remaining bit that we ARE still in possession of, OR do I register ALL the land as shown on our pre registration deeds, and if the neighbour then wishes to claim adverse possession at a later date, then that is for him to show??</span></span></span><br> <br> <span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">&#160;Why I am asking, is that when I send in the application, and the registry examine the documents provided, will the registry not question why I am only seeking to register PART of the land shown in the pre reg deeds, when registration of all land on a disposition is now compulsory..</span></span></span><br> <br> <span style="font-size:11pt;"><span style="line-height:115%;"><span style="font-family:&quot;Calibri&quot;,&quot;sans-serif&quot;;">Thank you..</span></span></span><br> <br> &#160;

John - it is for you to decide what you apply to register and we won't query why you have not included any additional unregistered land. You have to prove title to the land you are applying to register&#160;<br> I would recommend that you do seek legal advice to understand how the law vies such scenarios and what the legal position is re the extra land/house and what options exist
