Dear Land Registry, I appreciate you are not allowed to give legal advice but I have a query regarding which form/evidence needs to be filed with yourselves. Apologies if you have already answered a similar query to this- I have tried to search the forum and cannot locate the answer. I am assisting a family member to fill in forms AP1 and AS1 for a property (I am aware ID1 also required and authority under the probate etc as owners deceased some years ago) The official copy of the title register shows a charge/covenant for the local authority under s 8 housing act 1980 ( the property was purchased from council under right to buy- this charge/covenant was for repayment of the discount if property then re-sold within the 5 year period) The Property was purchased from council in the 1980's and not subsequently sold or leased so the five year period under the charge has long expired. Q1) What form needs to be submitted to remove this charge from the register? Is it RX3? Q2) Do the Land Registry require any evidence from the local authority who have benefit of the charge even though charge has long expired? Many thanks for your time.

Dear Kelly - the 'discount' charge as it's known will be automatically cancelled when your application is processed. The discount period has passed so nothing more to be done.

Dear Kelly - glad the response was helpful. When you submit your application feel free to inc a note to flag the discount charge and that the time has now passed. Just helps to ensure it's removed as part of the processing
