Dear Sir, Madam,

we have an question about right of access to our own property.
the previous owner has sold a part of his estate and now we need to cross his land to access the property.
Would a ST4 be sufficient, seeing that the road to the property has been used uninterrupted for more than 20 years?

Dear Juergen - if you are looking to register a claim as to a prescriptive easement (right) then form ST4 can be used. See PG 52 for guidance on how to register but please do seek legal advice. You need to establish that you have gained such a right before then applying to register it.

If we have the right and would put in an application, how long would it take?

Or could it fast tracked due to pending sale?

G M Juergen - wait times are very lengthy so if there is an urgency due to a confirmed purchase then once submitted a request for expedition can then be made to keep the wait time as short as possible. Everything then hinges on it being in order.
