I have a loan on this title number but my solicitor didn’t want to complete the transaction. The bank’s solicitor completed on both parts without a valid ILA. The loan expires on the 8th of September and now they are trying to expedite. Can this be registered in their name without a valid ILA and no completion statement after almost 12months. Can i some how get this put on hold.

George - not too sure what it is you are referring to. I assume ILA means Independent Legal Advice but I'm not sure how that all links to the registered information. We currently have an expedited application to update the register by removing one of the legal charges (secured loan). You can't put that on hold.

I received independent legal advice from my solicitor but he didn't complete the transaction the lending solicitor completed both parts as my solicitor refused. After 12 months i still haven’t received a completion statement. Their is no Independent legal advice certificate as i didn’t get one for the solicitor who completed on the banks behalf.

George - noted and appreciated but that wouldn't involve us at HMLR. Once the current application is processed and completed the updated register will be available online. If successful the legal charge will be removed and no longer appear on the register itself

This is not for the removal of the current charge but a charge that may go on there soon.

In the next 3 weeks a lender may try to put a charge on this title number. I’d like to flag this as procedure wasn’t followed. No ILA certificate was given to the solicitor who completed the transaction and no completion statement has ever been received.

George - we don't offer a 'flag' service of the type you refer to. You can use our free Property Alert Service to be notified of a significant application so that you at least know if and when a significant application is submitted and who has made it. https://www.gov.uk/guidance/property-alert

Any issues you have re No ILA or completion statement are not ones we would record or consider. If the application includes an executed and dated legal charge securing the loan against the correct property then we can process and register it. If you wish to challenge the legality of the legal charge you have signed you should seek legal advice and take legal action as appropriate. If your legal argument is sound the applicant (lender) can withdraw/cancel any application they might make.

George - I have responded to your further question in the absence of my colleague. There is only one application currently pending on the title - the one my colleague mentioned about earlier.
