Hello, I’m a carer for my 85yr old mother. In Oct ‘23 an application (D300WDT?) was made, via probate solicitor, to change the registered title of her property into her sole name following the death of my father. In July of this year the solicitor sent us a form, requested by HMLR for completion, and led us to believe the application was reaching it’s final stages. On the strength of this, and due to my mother’s declining health, we started the process of buying a specialist retirement property for her needs, and putting her existing property on the market. Both processes went well and have now reached the conveyancing stages.
However, I have just learned, via the conveyancing solicitor, that the original HMLR application has been cancelled and that the probate solicitor has had to resubmit. We were not informed about this. I am unable to find out why the application was cancelled and whether they have asked, bearing in mind how long we’ve waited and the situation of which they are aware, for the resubmission to be expedited.
I am worried sick that, through no fault of our own, mum’s move will be put at risk. As I’m handling all processes on her behalf, as well as acting as her day-to-day carer in an increasingly unsuitable environment, the strain is burdensome, to say the least. What can I do?

Hello Andrew - I am sorry to read of the issues you have and are facing. The original application was cancelled on 15th August as you state. It appears that the solicitor has since lodged two new applications on 30th Aug and 13th Sept and both appear to be for the same/similar update.
The original application had been expedited but the newly lodged ones have as yet not been as no request to do so has been made
In light of the issues you refer to and the fact that the original application was expedited I will ask colleagues to expedite the new applications. That should mean that they are considered asap and hopefully, if now in order, processed to completion.
I'll make a note to check during the week for progress but please feel free to post again later in the week for an update also

Andrew - the application has been completed and the register updated. So I am pretty sure you should now be able to move forward
The only caveat to that is that the conveyancer lodged a second application as well but which appears to be for the same update. You may wish to speak to the conveyancer again to confirm the actual update and to confirm if they need to withdraw the second application or not before the casework team consider it

Thank you, Adam, for following up on the case and keeping us updated.

The latest interim application was another from the probate solicitors who’d sent us another ST5 to complete. As it’s now appears superfluous I have asked them to withdraw the application as advised.

I am delighted that the register has been duly updated and that this possible obstacle to us moving on time has been cleared. Both myself and Mum send our sincere thanks to yourself, for arranging this in such short time, and to the team involved in helping to expedite this.
