Hi,

Could you please check if the application to remove the title restriction has been submitted on bl67605?

Could you please give me a rough idea of timescale?

If it hasn't been submitted yet, what is the typical timescale for an application to remove a restriction on a title (for 1936 chancel repairs).

*edit - it is to remove two unknown restrictions (1934 & 1935), not the 1936 one.

Hi Lara - nothing as yet and wait times are lengthy so if there's a need for speed then a request to expedite should be made after the application has been submitted - Request an expedite - GOV.UK

Thank you Adam, excellent service!

Can you give an idea of timescales with no expedite for determination of a rentcharge via CN1 on the basis of adverse possession? I know it's not exact but would it be days or months?

Our seller is applying to have it removed, but could it be far it be far quicker for us as the purchaser to make the application at the same time as the application to register the transfer?

I am assuming there is no risk of the application failing, from a 90 year old conveyance which has never been demanded?

Lara - not really as so much depends on the evidence provided and whether that needs reviewing by a senior officer/layer or not. Average timescales are a few weeks I would suggest but impossible to be definitive
Obviously far quicker to complete and request removal but that's often a choice for your mortgage lender first, conveyancer second and you third.
What risk exists is for your conveyancer to consider and advise upon. The law is a complex one where payment has not been taken and that's the sole basis of a claim to determine the rentcharge. Your conveyancer is the one to advise you in that regard and may well prefer to leave that risk with the seller and not you

Dear Lara - never make promises you may not be able to keep
Lodged 15th July. Expedited and partially processed on 16th July; case referred to senior officer for consideration as to whether all ok or more is needed
I will ask the casework team if it can be escalated in anyway but it may still be a bit longer before we have an idea re next steps

Lara - the casework team have gone back to the conveyancer on the 22nd July with option(s) re a way forward.
Apologies as they did not tell me that but did escalate it so I can't grumble too much
They have been asked to respond to confirm by 29th July - the ball is currently in Wards court as a result

Lara - the application was completed and the register updated this morning. The conveyancer was informed and the new registered info is available online. All resolved
