Hi I really hope someone can advise me.

We are trying to purchase a property but it’s been discovered it was never digitally registered, and the elderly owners can only find part of the deeds that are not signed.
They have provided a statement of truth with this.

Is there any way I can find out if the owners solicitors have put the application in yet?

Thanks

Lauren

Hi Lauren - if they have then they should have an acknowledgement quoting the provisional title number and case reference?
If you don't have that then what's the postal address please?

Hi Adam

Thank you for looking into this for me.

I have another question if that’s okay - when submitting a first application for registration, does it have to be made via post ?

Thanks

Lauren

Thanks for clarification Adam.

What are the current waiting times for an expedited first registration? And also, what’s the likelihood of an expedition being approved if there is risk of the buyers walking away/pulling out ?

Thank you

Lauren

Lauren - I can't see any reason why expedition should not be approved in such a scenario. Expedition gets the application to the processing start line asap, generally within 10 days but often much sooner.
However it isn't a 'magic wand' and everything really depends on whether the application is in order and capable of being completed. Those that are can be completed same day as processing starts but many can't be as more is needed
I'd suggest that they lodge it, then request expedition and then share the provisional title number with you. We can then check for an update a few days later

Hi Adam

Thanks for the information you’ve been really helpful.

As far as I’m aware the sellers solicitors have posted the first registration application yesterday so I will hopefully be able to get a title number soon.

Thanks again

Lauren

Hi Lauren - noted and appreciated. They should receive an acknowledgement confirming receipt and they can then use that detail to request expedition
The expedite request is a separate thing and requested through a dedicated channel. If they have made the request in writing and as part of their application then it won't be seen

Good morning Alex, I hope you’re well.

As far as I’m aware the first registration application was posted Last Monday, would you be able to check for me if this property is now showing on the portal? I have also asked my solicitors how I can find out if the sellers solicitors have yet applied for it to be expedited.

Kind regards

Lauren

Good Morning Lauren - received on 21st and expedited yesterday. Suggest you make a note to post again after the weekend and we can check to see if there's been any progress - can't guarantee that there will have been as expedition generally triggers the process starting within 10 days
SF708104

Hi Lauren - I don't need to know but if you do then you would need to confirm/clarify with the conveyancer acting for the seller.
SF708104

Good Afternoon Lauren - looks like the conveyancer has recently replied to our outstanding request. The case goes back to the casework team to review and then is referred to the senior officer to consider next steps
The expedite status means that happens as soon as possible but impossinble to be definitive re timescales as yet. The good news is that it is back in our court and progressing
SF708104
