Hi,

I understand an application has gone in to  change the deeds of the garage into the current owners name so we can complete the purchase of this property. Do you have any time estimates of when this will be completed. We are concerned our mortage application will expire soon and this won't have been sorted.

Hi Lisa - I assume the garage is one of those to the west of the property but do you know which number garage please?

Hi, 

Thanks for coming back to me. Yes, as you look to the west of the garden the garage is the bottom one next to the back gate of the property.  The back of the garage runs along the edge of the garden line.

Just to also add, the garage is currently in the owners name from 4/5 previous owners, I understand that in the buying and selling of the property the garage hasn't ever been transferred from person to person. 

My understanding is it need to go into the current owners name before it can be swapped into ours after purchase.

Hi Lisa - ok, then I think it's the garage as registered under title NN41215 as that's the bottom/first garage nearest Number 11 and is in a previous owner's name from 2009. Not 3.5 previous owners but enough to be an issue.
Unfortunately there's no application as yet to update the register and in such cases we would need to see a Transfer by the still registered owner to whoever, usually the current owner of Number 11/the seller
I'd suggest going back through your conveyancer to query what's happening and to also confirm if that's the right garage/title number as well

Thank you, that's the correct title number as I've seen it on a document.

What's intresting is that the solicitors have assured me they submitted the documents before Christmas for this to be changed. 

How long approximately does it take once you have recieved the details.

Lisa - they need to submit a transfer by current registered owner to new one as appropriate. Same requirements as if it was a sale/purchase re property etc 
Once submitted they then need to request expedition to fast track it. If they do that then it can generally be processed within 2 weeks providing of course everything is in order
The 'hard' bit is usually tracking down the still registered owner and getting her to play ball and complete and do everything that's needed. That's likely to take time I suspect and maybe why we haven't yet received an application
Hopefully something is happening in the background and the conveyancer(s) can confirm for you

Thank you so much, I believe the owner from 2009 is the current owners Mother so it should be to difficult to track her down! I will contact the solicitors now.

I have spoken with the Solicitors and they have advised that they need to put in an Adverse possession claim for the garage title NN41215 could you advise if this has been done? Also how long approximately does something like this take to complete?

Morning Lisa - nothing as yet. The wait time would be several months so if there's an urgency they would also need to request expedition after it has been submitted - Request an expedite - GOV.UK

Once processing starts there will also be a time lag whilst the registration requirements are met and checks made as appropriate - see PG 4 for guidance on the process Adverse possession of registered land (PG4) - GOV.UK

The wait time, even with expedition, is likely to be several weeks still

Lisa - expedition simply gets the case to the processing start line usually within 10 days. Thereafter it all depends on if it's in order, whether a site visit is needed and whether wider checks are also required. Three key stages usually and even with expedition you are looking at a timescale of at least 10 weeks and probably more. The site visit and wider checks can't be fast-tracked.

Good Morning Lisa - it has and it has also been partially processed.
As it involves a claim as to ownership then it falls into the complex category and needs to be considered by a senior technician. That will happen asap and next steps then approved.
There are 3 main stages to most applications of this sort. The first is checking that the statement of truth is sufficient. The second is a site visit/survey. And the third is wider checks with for example already registered owners.
Stage 1 is always necessary of course. Stages 2 and 3 may not be depending on the specific circumstances. But each stage follows on from one another so we need to wait until stage 1 completes before seeing what next steps are needed
