Hi I am currently in the process of purchasing a property 3 greystead close, chapel park, NE5 1SR and the solicitor has noticed an error with the title lease so they have chased it up with the land registry to have it amended before the sale of the property can go through could you tell me how long this could take?

Hi Paul - nothing showing against that title to indicate any contact so far re any amendment to the lease etc

Hi Adam thanks for your reply the sellers solicitors advised that they’ve disputed it with the land registry as there is an error with the acreage on the title is it only the solicitor that can ask for this to be rectified or or is there anything anyone else can do to get this amended as it’s holding up the purchase of the property thanks

Hi Paul - anyone can report an error and provide supporting information/evidence as appropriate - Public guidance: dealing with land and property - GOV.UK 
I'd follow it through with the solicitor though to be certain as we don't register the acreage and you referred to an error with the title lease. If they have submitted anything then ask them to confirm the title number and/or our enquiry reference

Hi Adam sorry my mistake about the title lease it’s actually the acreage it’s stating that it’s got 34 acres on the lease document which is incorrect as that’s a lot of land and it only has a Medium sized garden so that’s what they were wanting to query and I was advised that would need to be changed for the sale to be completed is this correct? I will chase it up with the solicitor to see if they have that enquiry reference thanks Paul

Hi Paul - no apology needed 
We can't amend a lease once registered. If the lease is wrong and needs amending in some way then the landlord and tenant would usually need to enter into a deed of variation to vary the original lease and 'correct' the specific error. The rest of the lease then remains in force and an application is then made to register that deed against the leasehold and superior title as appropriate.

Paul - any application to update the register can be expedited as appropriate
A request to amend a registered title is dealt with as quickly as possible but there's no expedition process for 'amendments'

Paul - there's no timescale other than as soon as possible. That's generally 2-3 weeks but so much depends on what the error is and how it can be corrected

Thanks Adam it would be a case of having the acreage amended to what it should be as the lender won’t release funds as it stands at 34 acres so would that be classed as a normal amendment thanks

Hi Adam I’ve been advised that an application has been made to the land registry to make the necessary changes needed and that it has been expedited I have been given a reference number j773gyt could you advise me how far along the application is and what date it was submitted Thankyou Paul

Hi Paul - submitted on 21st July and partially processed. We needed more from the conveyancer, which they have supplied, and it's now with a senior officer to consider next steps. Hopefully we will know more in the coming days
