Hi there,

Unsure if you can help me, I am in the process of buying a property and can't exchange until a transfer has been made with yourselves (essentially the seller transferred the property to a related company), I've been informed that it has been expediated but there's been no further updates on status or any ETA's on completion. I see online 95% of cases are processed in 10 working days which is somewhat reassuring, but I am just unable to relax fully not knowing the status. I have a lease on a rented property expiring and I am getting anxious waiting on news. I just wondered, based on other threads if there was any way, as the buyer I could get any info? I don't have a case number or anything unfortunately, not sure if you can search with any other info?

Hi Lisa - expedition gets the case to the processing start line, generally within 10 days. It doesn't guarantee it is then completed within 10 days but it can be if all in order etc
What's the postal address involved please?

Thanks Adam, understood, the address is9 the Sorting House, 190-194 st anns hill, Wandsworth, London, SW18 2RT. I'm unsure when exactly it was approved for expedition, only that it is being worked on.
If you can find anything further would really appreciate it.

Lisa - there are a few applications pending against the address including a few new leases of other Apartments which have completed.
I assume the expedited application you are referring to relates to a surrender of the existing lease re the ground floor of 194 but if so then we are waiting on the conveyancer to respond to our request for more information issued to them in June.
I'd suggest going back to your own conveyancer to confirm where the delay lies and what the landlord/seller is advising. It's possible that if you are buying with a mortgage that your lender requires greater certainty re a completed register update re the surrendered lease before they will allow you to complete

Thanks again Adam, what i've been told is that the seller transferred the property to a related company and this transfer has to be registered with HMLR, so i'm unsure if this is the same thing as you're referring to above? Forgive me but not 100% sure on all the jargon and what it means. You mention the ground floor and my property is first floor so just also wanted to confirm on that? If wouldn't mind letting me know that so I can just 100% make sure this referring to mine so I can go back to my solicitor. And again, thanks so much, really appreciate it!

Lisa - there are a number of registered titles involved out of which new leases are being granted. There is an application to update the registers re a change of ownership and others besides.
I don;t know the lie of the land so to speak but assume there has been some redevelopment of the site with a number of apartments being leased whilst an existing lease, which refers to the ground floor is surrendered. That's not directly linked to your own or the new apartments I suspect so I would not concern yourself re the floor levels as a result 
So the various titles, transfer and your apartment and a number of others are 100% what is being referred to so you can go back to your conveyancer to clarify and confirm the specific delay and seek clarification from the seller/landlord as explained re the outstanding request dated 17th June

Thanks again, Adam! You have made a good guess re the lie of the land, it's exactly that. And re my apartment my solicitor won't proceed to exchange till we have this change in place. Good to know re the floor not being a concern I just wanted to check that is mine is number 9 and first floor. I have been told the case is being worked on by HMLR but i'm very grateful you've mentioned this request as it sounds like this has maybe been missed, my solicitor will relay that to them today.

Hi Adam,

Finally I have managed to get word that they should have now provided HMLR everything that had been requested. I don't suppose you are able to confirm with me that everything that was needed has been received?
Will just put my mind at rest things are getting closer ahead of the weekend.

Hi Lisa - nothing showing up as yet re our request of 17th June. The conveyancer would normally respond through their secure portal so it should appear immediately.

Lisa - I can't share specific details but the request included a number of points re the paperwork submitted. Bottom line is we have had no reply as yet

Okay I understand. I have spoken to my solicitor and have been told there is 2 applications with yourself - I think the one you are referring to is maybe the other one? Mine is related to the transfer of ownership from one company to another and they do believe HMLR should have everything for this one, are you able to see if there's another?

Lisa - there are two applications from the same conveyancer, one of which involves a Transfer. Both have separate requests issued on the 17th June and both are awaiting replies from the same conveyancer (Banks Kelly). So I'm referring to both of those applications 
You then have three separate applications to register new leases

Hi Adam I got clarification this morning that they do believe they have responded to all the requisitions in June, so they are going contact HMLR directly to clarify as it sounds like something has went amiss somewhere. Hoping this can be cleared up now.

Thanks Adam, there's no way they could have sent this to a case officer directly rather than via your portal? I am just getting increasingly worried as I cannot exchange till this is sorted and I just don't understand where the miscommunication is. They are telling my solicitor they have submitted everything, and did back in June, but since I am hearing different from yourself I just feel every day that goes by nothing is happening and time is being wasted in terms of this getting sorted. I have again fed back your comments, and asked if they can check again, is there a way you can contact them from your side to confirm they are waiting for this? Sorry to keep asking for help, I just don't know what to do here!

Lisa - no as anything received is added to the case and does not directly involve a caseworker until after that has happened.
The only recorded contact from the conveyancer was in June when they referred to the urgency. But nothing since 17th June 
I'll contact them myself to explain

Okay thanks Adam really appreciate you getting in touch, I was told again yesterday that everything has been sent and that I need to stop chasing personally, but I am just trying to be proactive so if you're able to let them know this is not the case i'd so appreciate it. If it's not too much bother if you could reply in this thread if and when you hear any updates / get a response from them? As now i'm not sure i'll hear much from the other side as they have told me everything has been sent we are waiting... Many thanks again!
