Hello, I am purchasing a property that I believe has a live adverse possession application underway. I am not receiving much in the way of updates from neither my, nor the sellers conveyancing team, and am therefore here to hopefully request an update. I hope you can help. I don't have an application reference unfortunately, but I do have a Title number CE88607 for the property we are purchasing. I would like to know, if possible, the stage at which the application is at, and the expected time of notice that will be given. We have been told 65 business days but I expect/hope that this is worst case scenario. Many thanks in advance.

Hello J McCabe - I cannot find any application associated with the property currently pending with us. There was an application submitted against the title CE88607 on 29 June 2026 but it was cancelled 21 July 2026 because it was incorrect type of application. No other application has been submitted since then involving the land concerned. You will need to check with the parties involved to ask what is happening.

Thank you Nimish, and for the quick response. That doesn't sound very promising. The application is for the rear of the property and related specifically to the driveway and part garden area. I know this particular parcel of land has no title number registered to it, could this then mean it is not linked to that title number and is therefore a first registration as opposed to an adverse possession? Thank you again.

J McCabe - that would be a reasonable assumption to make but as yet the conveyancer has not applied to register the driveway and part garden land you refer to. Once they have they should be able to confirm the provisional title number and case reference for you.

Hi Adam. That is really disappointing and probably explains why we have not been kept up to date. I will speak to my solicitor. Can I just add, this service has been extremely useful and I only wish I had come across it earlier. Many thanks for your help.

Hi J McCabe - these things can happen as sometimes the 'missing' land is only spotted late in the selling/buying process. How to remedy that can be tricky at times but the time then needed can be very frustrating as the end was in sight for many. Thank you for your kind words - let us know once submitted and we can take a look and give you an idea of timescales from there. A lot will depend on what they apply for of course but they should be able to confirm that detail for you as well
