Is it possible to have an update on Adverse Possession Applcation -SK220682? This was submitted on 16th July and a 'chain of sales' is awaiting response. Also can this be expedited?

Susan - the application was submitted on 6th June. Already expedited on 9th June. Partially processed on 10th June but the complexities of such a claim require referral to a senior officer/lawyer.
A survey/site visit was also required and OS reported back on 20th June
The conveyancer was contacted on 2nd July with a request for more information and they responded on the 17th and 29th July
The application and replies are now waiting to be reviewed again by a senior officer/lawyer as appropriate to decide if the application can proceed and what next steps remain.
I'll ask the casework team for an update but I suspect there is still a way to go yet before this one can be completed

One more question - if it has been expedited because sales awaiting this - what timescale are we looking at?

Susan - still a way to go I suspect and as the application will affect registered land/property then other owners are likely to need to be contacted to see if they have any objections.
I suspect you are still looking at a few weeks minimum but we won't know until the review is done
The expedition has done it's job in that processing has started much sooner than it would normally have done. Expedition doesn't then wave or negate the need for everything to be checked/confirmed

Hi Susan - I have responded to your further post in the absence of my colleague.
The senior officer has asked for a survey to be carried out. We will be writing to those involved informing about the survey shortly.

Sue - The survey in June was in relation claim of error on the title. The application now is for claim of ownership under Adverse Possession.

I understand the above but not sure why the same survey cannot be used but no doubt you have your rules. However as noted above a 'chain of sales' is awaiting this when will those involved be contacted?

Sue - The instructions from the senior officer have been given in the last couple of days so I would expect the letters to go out very soon.

As you can see from above thread another survey is to be completed and it is noted that letters were to be sent. This was 2 weeks ago and we have had no contact. Please may I have an update. Thanks.

Susan - notices are to be served shortly on the owner of the land with an expiry period of 65 days so there may still be some time to wait before matters complete.
If the recipient responds sooner and positively then the applications can be completed sooner
I have asked the casework team to issue the notice asap

Again thanks for your swift reply. Another point - the issue concerns not land but part of a property that adjoins my flying freehold. and according to documents attached the name on the deeds of that property is not the current owner. I have tracked down Jeremy Cole[the name on the letter from Land Registry] and believe he owned the company that let the property in the past. That company no longer exists but I have tracked down his current address. How is this going to effect matters?

Susan - if a company no longer exists then it's legal advice you need with regards what happens to and how the assets of the company are treated in law. Much will depend on how the company 'ceased to exist'

Re the above application. I understand the process of waiting for 63 days. It was issued on 27 Aug and expires on 26 Nov. This is more than 63 days - is this because only working days are counted and not weekends?

Susan - it's 65 days and working days, which doesn't inc weekends when used in that context, as you state. The time expires on 26th November

Re the above - the deadline expired on 26th and the case was expedited but we have had no response. Sales/purchases are dependent upon this - please may we have a response asap. Thanks
