Hi, I’m looking for some information on an expedited application on land title number LT112632. We are in the process of purchasing this property but raised concerns regarding the boundary. A survey was completed on the property on Monday 30th March and told the report would be submitted Thursday 2nd April. It was implied by the surveyor that this would be a simple case as he believed the boundary had been recorded wrong on the original title plan due to the tree line. We have been waiting for an update from the sellers solicitor for a month and our mortgage is due to expire on June 14th. Our buyers require a months notice to their landlord which is narrowing our window to complete even more. If we have to remortgage in the current financial climate with the current mortgage rates we are at a high risk of not being able to afford the property and have to cancel the whole deal. Our buyers will almost certainly pull out and we will loose our dream home. Could you please provide us with an update as we are getting knowhere with the sellers solicitors. Thank you in advance

Hi Emma - the application is to register additional land to the rear of the property and adjoining the title number you refer to. The survey has been done and the application and report are with our lawyers on referral to consider next steps. I'll flag the urgency you have expressed with the referral team but must stress that there may still be some delay involved in the process if more is needed from the conveyancer and/or wider checks requested. Emma - very much so as the application is based on a claim as to ownership. As a result the legal requirements have to be met first. If they are the registration ones come next. Your conveyancer should be aware of what's involved both re the application as submitted and what the registration process involves. LT566847

Thank you Adam. We were led to believe that the application was for adverse possession of the land, as the homeowner had been using it for a considerable period of time. We were unaware that the application was for registering additional land and adjoining the titles - I can see why this process would be lengthy. In your experience, has anyone ever completed on a house sale while the application is on going? Thank you again

Emma - that's correct hence my reference to their 'claim' as to ownership. It is possible, in my experience, to complete but in modern times that is almost certainly not possible if you are buying with a mortgage. The lender's mortgage product will not allow them to complete until the registered information is confirmed and available. Your conveyancer/lender should be able to confirm for you. LT566847

Good afternoon, Our solicitors have been in touch with our sellers solicitor and is reporting that she hasn’t received anything from Land Registry. When you said you have written to her, was this via email or post? I am very conscious of not causing any delays. Thank you
