Hello<br> I am buying a small piece of garden from a neighbour. Their solicitor will be providing me with an AP1 form for evidence of the sale. I wanted to check if it's me that needs to submit the TR1 form or the neighbour selling the land? <br> Their property has no mortgage on it, mine currently does. <br> Also the property owners sister has power of attorney, so when completing the TR1 do I include her details, the propoerty owners, or both?<br> The solicitor I have spoken to wants to charge me 900GBP to complete the form so I am keen to do this myself as it seems a reasonably straight forward process. <br> Thanks

Hello David<br> <br> If you are intending to submit the application then the form AP1 would be completed by you. <br> <br> The seller or their solicitor should provide you the transfer deed which is executed by the seller or their attorney.  This should be accompanied by relevant evidence of identity in form ID1 or form ID3 for the seller and their attorney, if they are not legally represented.  You would then complete the form AP1, Stamp Duty Land Tax evidence, and your own evidence of identity in form ID1 or form ID3 . <br> <br> It is not clear from the information you have given if the piece of land is registered under its own title or if it is part of larger piece of land owned by the seller.  If it is entirety of the title then a form TR1 is correct.  However, if it is part of larger piece of land, then it would have to be form TP1. <br> <br> Hope this helps.

<p>Thanks for the response. I submitted the forms around 3 weeks ago which I completed myself, so there is a chance that I did it incorrectly. <br> When would I hear if something is incorrect and needs addressing? <br> Thanks</p>

Hi David - We do have some delays in processing such applications so don't be concerned if you do not hear from us for a while.  Our current <a href="https://www.gov.uk/guidance/hm-land-registry-processing-times">processing times</a> for such applications can be found on our website.<br> <br> If there is any issue with the application then we will write you.

David - received 25th September. Wait times are very lengthy so it won't be until the end of next year/early the following year that processing starts. The casework team will contact you as appropriate when processing starts <br> Provisional new title BD363705

Thanks for the update. Just to confirm end of 2026/early 2027? Just want to confirm timelines as now the transferor has sold the piece of garden to me they are putting the rest of the property on the market.

David - timelines as stated. The neighbour selling is not an issue as the buyer will check and confirm the transferred part is pending and all moves on as appropriate with the conveyancers/lender involved<br> BD363705
