We have applied for possessory title for a parcel of land which essentially forms part of our front garden (has done since house built in 50s) due to Road constructed differently to original plans. It was previously unregistered.

Application submitted July 2023, with attestations from prev. owners of continuous possession. 

HMLR quickly identified this parcel of land on title search, and a title ref now exists. Clicking in, it says : “This service is new and some information is not available here yet.”

Two questions:
- how far down the road are we, and what is the estimated timescale for such transactions.
- the “clock” for absolute title - does it tick from the application date for possessory, or the HMLR processed date?

N L - if it was submitted in July then it will still be waiting to be processed. The average wait time at present is around 14 months but that is very much an average only.
When processing starts there are normally three key stages - 1. Consideration of the facts of the claim 2 A site visit/survey and 3. Wider checks issued to adjoining land/property owners as appropriate
Stages 1 and 2 will usually trigger contact with the applicant either to ask for more information/query the information provided. Stage 2 will trigger contact to advise of how the survey is arranged.
The 12 year period after Possessory title has bene granted commences from the date of receipt of the application as that's the date that will be used to record when it was registered. So the lengthy wait time and processing period form part of that 12 year period
