Hello,
please could I have some urgent help? My solicitors have informed me that the management company that owns 60% of my house has had a land registry application pending for around the last 2 years. I am selling my property, and the buyer’s solicitors won’t complete until the land registry is updated by the management company’s details. I have been going through this process for the last 10 months, and pending this, should be due to complete in the next few weeks, this is threatening to lose my buyer. I have had 2 buyers pull out already I can’t not afford to lose this buyer. I have been loosely informed that the management company have expedited the application, but I need this completing as soon as possible to keep this buyer and allow a successful completion of sale. Is there anything that you can do to help me urgently?

Ellen - many thanks. The freeholder's title is WR171826 and there are a number of applications pending against it and at the present time the register cannot be updated re your leasehold details. It is that which I suspect is the issue for the buyer's conveyancer/lender.
The delay is as a result of a prior application re Plot 31 as lodged by Property Legal as we need more information from them to enable the plot purchase to be completed and the register to be updated. They have asked form more time and have until 6th July to provide the required information 
I would suggest asking your conveyancer to contact the freeholder/your seller to see if they can assist the conveyancer in resolving the outstanding issues

Is there any possibility of our application being processed before (plot 31), as I understand this is a different house and has not linked to our property. We really need this application to be completed so we can complete the sale. For all we know, this could be waiting on 3rd parties  etc, and could take months to resolve the issues. If there is any way around this or further information it would be appreciated. Thank you

Hello, 

further to the above, we have been in contact with the owners of plot 31. They have been extremely helpful and are eager to get this completed as soon as possible too for their own property. They have asked whether you could provide a specific contact at property legal who is dealing with the case, so they can follow up with them directly?

Ellen - we wouldn't do that via a public forum and they should contact their conveyancer direct to get such details

Ellen - sadly not. The freehold title will only be updated in priority order so until plot 31 is completed we can't update it further with regards your own leasehold title or the other still pending applications
The only way round it is with the lender involved to see if they can relax their requirement - they know your own title has been registered and updating the freehold title is a formality. However their process/risk profile re the mortgage product may mean they won't bend on the point. Please do rely on your own legal rep for guidance/advice in that regard

Okay, so if plot 31 can be updated with the right information, the land registry for my plot will be able to be completed next?

Ellen - once the registration of Plot 31 is completed the seller/landlord's title can then be updated in priority order. It's a bit like a set of dominoes toppling over 
There are other leasehold titles, like yours, that have all been completed but the landlord's title does not as yet refer
Your new title WR208961 is already completed but the lender requires it to appear on the landlord's title for completeness
2 other, also completed, leases will be added before your own and the only delay might be a separate application to register a Notice against the same title.
I have asked casework colleagues to check that application to confirm it is in order and capable of being registered quickly as well
But nothing can start toppling until plot 31 is completed

we have had confirmation from plot 31 that their land registry application has been completed. Are you able to expedite and complete the other cases ahead of us as this is still blocking our completion and sale of the house?
