I am filling out a TR1 form to transfer ownership as a part of separation/divorce. The separation is amicable and all financial considerations are resolved at our discretion, ie. no third party involved. I understand the transfer is exempt from stamp duty, but what kind of document is acceptable to prove that when stating a consideration in panel 8 of the form? There are no court orders, just the HMCTS divorce proceedings paperwork.

Nic - if the transfer is exempt then you should confirm that this is the case either in a covering letter or in panel 11 (additional provisions) of form TR1. Use the specific details confirmed by HMRC as appropriate and also ensure that the 'consideration' refers to the separation/divorce proceedings and HMCTS paperwork
