HCA not supplying DS1 Form

Hi there,
I bought my house in February with title GR424567. Due to work relocating I have had to sell the property and move. I sold subject to contract in August and nothing has moved forward because the HCA have not issued a DS1 form to the previously sellers solicitors to discharge a help to buy loan on the property from the previous owners.
I have been told there has been multiple attempts to chase the HCA with no response
I am now at significant risk of losing my onward purchase at a great expense.
any help would be greatly appreciated

Hi Thomas - I am sorry to read of the issues you are facing re the title/property. There's little we can do here as the issue needs to be resolved by the seller's conveyancer and HCA with the latter providing the required discharge of their legal charge (mortgage)
In such cases there is an often an issue with the paperwork submitted to HCA or a shortfall re the redemption payment which means they can't complete the process.
I will raise it with Homes England (once HCA) to see if they can confirm what the issue is but I must stress that it is very much the conveyancer's responsibility for doing that direct with HCA - chasing the process rarely results in a solution. Identifying what the issue is and resolving it can work although I appreciate 'no response' suggests a wider problem
I'll post again when I have a better idea of what the issue might be from HCA's perspective
