Hi,

I have the benefit of a 5 year lease with a call option and option for renewal. If I apply for a notice to note the lease on the register, then would that also protect the options contained in the lease?

Or alternatively will I need to submit an AN1 in respect of the lease and call options separately?
 

would greatly appreciate any assistance with this.

Hi Gary - our PG 25 section 6.3 explains how leases that can't be registered in own right might be protected on the register - Practice guide 25: leases - when to register - GOV.UK
If the lease is noted then the interest it creates is protected in terms of 'priority' on the register so any later interests are subject to it. We can't advise you on what you need to do or what's best here to protect your interest and if in doubt I would strongly recommend seeking legal advice

Hi Adam, thank you for the reply.

I now understand that my lease can be noted, however if I apply under AN1 to note the lease will the Land Registry also note the existence of the option to purchase which is contained in the lease? 

I am trying to see if I need to file one AN1 or two AN1’s with one being to note the lease and the other to note the option to purchase.

Any further information would be greatly appreciated.
