Hello,

My mother & father were joint tenants on their property. My father died in 2008 & unfortunately a DJP form was never completed so the property ownership is still showing as in joint names. My mother has now passed away and I am the beneficiary of the property & wish to transfer it to myself & my husband. I have both death certificates & Letters of Administration for my mother. Unsure of which forms to complete with it still being in both parents names, does a DJP have to be completed first before the AS1 & AP1 plus evidence of identity or does my Father's death certificate suffice?

Many Thanks

Hello Cheryl - you don't need form DJP pr two separate applications here.
Forms AP1, AS1, ID1/ID3 plus certified copies of the letters of administration and your Father's death certificate can be submitted as a single application

Thank you Adam,

When completing the AS1 form would both of my parents names go in section 4 - Name of deceased proprietor? Also I am the beneficiary but can the property be put into mine & my husbands name at my request?

Cheryl - no, just your Mother's as she was the sole surviving legal owner for who letters of administration were required
It can be transferred into your joint names, yes, by way of the form AS1
Technically it should be a form TR1 as you are transferring to a beneficiary and a third party but there is no issue in your using a form AS1 in your specific scenario
