Hi Adam

Hope you are well. Two situations

My parents were in a car crash and dad did not make it. They are joint proprietors (I don't know if in common or joint tenants - does it make a difference?), and mum simply wants to transfer full ownership to me. So we have both dealing with the death and transfer from them to me (no cash transaction involved). How do I do this, and what is the fee(s)? Note that as it was a car crash, there has been a post mortem. More tests have to be done, but an interim death certificate has been issued, so we can have the funeral. Is an interim death certificate fine, or do you need the final (which will come in a couple of months)?

My in-laws want to keep ownership of their property, but add my husband and I, and all four of us become joint tenants (no cash transaction involved). The proprietorship register currently does not show joint tenants or tenants in common. How do we do this, and what is the fee?

Hi Nigel - all well thanks and so sorry to read of the tragedy
First thing first is that when it comes to the register and death of joint owners how they held it, JTs or TIC, rarely impacts in one regard.
Parents title - joint tenants so no form A restriction. On Dad's death the legal ownership which we register, passes to Mum. So she can now transfer the property to you using forms AP1, TR1 and ID1/ID3 for Mum and You plus a copy of Dad's interim death certificate
In Laws title - they are JTs and no form A restriction so again AP1, TR1 and ID1/ID3 for all four of you. Same transfer scenario and fee idea
I'll email you more info to explain what's needed in both cases with some additional detail
