Expedited application on freehold new build stuck behind prior applications — sale at risk

Hi, I'm hoping someone can look at my application and help. I bought my freehold new build three years ago, but registration of my ownership (a Transfer of Part from the developer's estate) was never completed and is still a pending application. Application reference: FB741D1 Title number: GR475601 I'm now selling, and the sale cannot complete until the registration goes through. It's urgent: I'm going through a divorce and my buyer is at risk of pulling out because of the delay. An expedite was requested through my conveyancer 3 months ago. When I called on Monday and again today (20th July) I was told there's no reason it can't be processed, but that there are prior applications ahead of mine. I've chased since but have had no update or timescale. Could someone please check my application and let me know: is a prior linked application (e.g. another plot or a developer application on the same estate) actually blocking mine, or am I simply in the general queue? And is there any indication of the likely timescale now the expedite is in? Is there anything more I can do - I'm getting really desperate. Thank you very much for any help.

Hi Ceri - you have all the information it seems although uncertain about the advice that there's no reason it can't be processed. There are a significant number of prior pending applications against the seller/developer's title which must be considered before your own plot purchase can be processed to the end. Thank you so much. There are houses that were built after mine that have been sold without any problems so I don't understand why i'm having this issue.

Ceri - the order in which houses are built and/or even sold is not a factor here. The order that counts is the order in which applications are submitted for registration and the 'priority' they have over others as a result. With large developments the site develops over time and that includes the nature and type of applications submitted to update the developer's title and create new ones for each plot purchase. The 'priority order' in which they can be done is crucial and where delays arise later applications suffer in the way your own, and others, has done The key from our perspective is checking to see whether any of the multiple applications ahead of your own affect/impact your own plot. If they do the delay will continue. If they don't there might be an opportunity to process your application out of priority order. If we can everything then relies on your own conveyancer of course having submitted a complete and accurate application

You conveyancer will be aware of the priority aspect and the delay and should be able to explain it as well

Okay. If you can share that information with me I can speak to the conveyancer. The issue is that it is the conveyancer that I used 3 years ago rather than the current one as apparently it was them that had to expedite it. Wards have put in the request and have told me they have also tried to follow up but according to them that is all they know. I have told my current solicitor that we have expedited it and I have been in touch with you but i'm trying to get an idea of what the issue is and how long so i can hopefully reassure my buyer.

Ceri - noted and appreciated. Any conveyancer should be able to explain how 'priority' works as that's precisely why you can't complete your own sale/purchase. I'll update here when I have a response from the casework team - that will take time as there are a lot of prior applications to review so please bear with me
