Hello
I am trying to purchase HE45253. There is a pending application on a small parcel of land (10m x 10m) - HE73338 - transfer of ownership requested in 2023. Requisitions have been raised on HE73338 and it has been expeditated a while ago now.
This is currently holding up the house sale and the solicitors cant agree on whether this issue must be solved for completion.
As you would see on the plans, the parcel of land in question is tiny and irrelevant to either party - could you shed any light on this? Will this be solved in the short term?

Hello Rose - we contacted the conveyancer dealing with HE73338 at end of June and as yet no reply.
The issue lies with the seller/transferor's paperwork re the release from their mortgage lender so I imagine the conveyancer is waiting on the seller's conveyancer to source the right paperwork
How soon it will be resolved is solely reliant on the lodging conveyancer at present so I can't be definitive

Hi Adam,
Could you tell me if the paperwork that was incorrect/missing (release from the mortgage lender) has now been uploaded to the portal yet?

Hi Rose - we have had a reply (yesterday) so that needs to be referred to and then reviewed by the casework team
I'll see if I can get an update for you so please bear with me and wait for a further post

Hi Rose - the casework team should be able to process it further today. I suspect, but will wait to confirm, that wider checks will now be needed to confirm the lender's release.
But hold fire and I'll confirm if that's needed and if so how long those checks might take

Rose - wider checks are required and are now underway. That involves contacting the transferor's (so your seller) mortgage lender to confirm all ok and above board. Those checks can complete sooner if they respond positively.
However they have until 5th September to respond
