My mother died a few years back, and my father died earlier this year. They owned a property jointly at the time of dad's death (dad didn't update the register on mum's death).

Now my sister and I are executors of dad's Will and the beneficiaries of the Will. The house is currently let to tenants and so at some point we will probably need to transfer the Title into our names rather than leaving it in the ownership of the estate indefinitely.

When completing TR1 do we put ourselves down as both transferors (as executors of the Will) and then again as transferees (as beneficiaries of the Will?)

If so, do we need to execute TR1 twice as both transferors or transferees?

(Maybe completing TR1 isn't the right way to go about this whole thing! Advice welcome, please - thanks).

Michael - yes. The executors, as named in his probate, are the Transferors and the beneficiaries are the Transferees.
Remember that if th4e executors are transferring the legal ownership to the beneficiaries then you would be using form AS1 (not TR1) in such a scenario. The form makes understanding the different roles easier to follow - Form AS1
HMLR Guide: Start - External · HM Land Registry

Land registration is complex, designed to protect legal and financial interests in property. There can be significant consequences for any error. Please consider seeking legal representation. Before making an application without legal representation, it is important to consider the benefits of using a conveyancer.

Coming back to this now.

My mother predeceased my father, but he never got round to removing her from the Title. They are still both listed as joint tenants.

If we complete an AS1 to transfer the Title to the beneficiaries do we need to include any documentation regarding my mother (eg. her death certificate)?

Michael - yes you do. A certified copy of her death certificate should be included
