Hi Adam, I wonder if you would be able to check if there has been a new application expedited for the Retreat?(Dt118ub). There was a small piece of land that was unable to be registered with the last application as it is already registered to someone else. My seller’s conveyancer has been instructed to apply for adverse possession of this as part of the conveyancing process. Many thanks Anna

Hi Anna - there's a parcel of land at the rear of the main property/land that was registered under adverse possession. The application was completed on the 9th May and I suspect that's the one you are referring to here DT492052

Hi Adam, It is a new application for the part that was not included (a pink area of land). We need to show that the application has been expedited and accepted before our mortgage company will accept the purchase. It is adverse possession of registered land, not the unregistered area. I hope that makes sense? Just wondering if you can see if a new application has been made. Many thanks Anna

Hi Anna - I don't quite follow your explanation. The property is now registered under the two titles I have quoted. There are no 'new' applications pending against them or any adjoining titles

Sorry Adam, Poor explanation by me. There was a small piece of land that was not included in the recent registration as it transpires that it is part of someone else’s title although it is within the property boundaries. Apparently they put in a new expedited application yesterday for this third small area of land, so hopefully it will be looked at soon. Many thanks Anna

Anna - no need to apologise but I now understand what it is you are referring to. There is a new application against another title DT209000. Processing will follow the same or similar path as it's a claim as to ownership although the difference is that it's already registered and within someone else's title. That poses an additional issue re timescales as if wider checks are needed with the actual registered owners then they are given a much longer period (65 days) in which to respond. The application has been expedited so processing will start as soon as possible. How long it then takes to be completed depends on several factors all falling into place over time.

Thank you Adam, So just to clarify, has the application been accepted as it stands? I understand that the process will take a long time, however I just need to know that the paperwork is accepted. Or will we know that later once processing starts? Thanks Anna

Anna - applications are always accepted as they stand. If there are any issues with the paperwork or application as a whole then the casework team will contact the conveyancer direct
