Hi, my mother died late last year and her partner 10 years ago. I was granted probate for my mother.&#160;<br> They had a mortgage together, but she didn’t remove his name from the deeds after he’d died. Now I am having difficulty selling the property as his name is still on the title. I can’t apply for probate for him as he was not my father and they were never married.&#160;<br> can anyone advise what I can do? In the mean time I have inherited another mortgage to pay and a huge DWP debt as they were paying interest only.&#160;

Hi Sallyann - you need a copy of his death certificate as well to confirm that fact. You don't need probate for him

Sallyann - if you have to update the register then form DJP plus death certificate are needed
But a buyer can often rely on the death certificate and probate in such scenarios without the need to update the register
Do check and confirm first to avoid additional work/delay
