Once an adverse pocession claim has been assigned to a case worker, how long after that approximately is it before parties are notified of the adverse possession claim? Will I be notified as the person applying for possession that the other party has been advised of the claim? Will I or the other party be notified when a surveyor is to be sent? Will they identify themselves to either party when attending? Thank you!

Steph - once a case is with a caseworker it is referred to a senior officer/lawyer to consider the legal and registration aspects. If a survey is then warranted OS are involved (2 weeks). They report back and the report is considered by the referral point again and generally notices are issued as appropriate. You are not notified as the applicant. The OS visit is organised by the applicant. There is no requirement for anyone to be on site for the visit as engaging with the applicant or anyone else is not the purpose of the visit. OS are our eyes, not ears, re such visits. They will confirm their identity and purpose if they encounter anyone on site.

Steph - the key thing here is that these types of application can and do take time. There are key stages, mentioned above, and if we are dealing with unregistered land then you are looking at 2-3 months processing time as a rough estimate. If the land is registered that is extended as the registered owner gets more time, if it gets that far, to consent/object to the claim. Until you get to the Notice period there is little that can be done to hasten matters further so you will need to be patient and don't try to set target dates too much in stone too soon if there's a sale/purchase involved for example.
