I am currently through a court process for placing a CCJ against monies due.&#160; This person, even with a CCJ, will refuse or claim they are unable to pay.&#160; However, I am aware they own properties outright.<br> <br> Once the court has applied the CCJ, is it possible to identify what properties they own (is there a search on the name) AND place a respective charge on it?&#160;&#160;

Abdul - whilst there is an index of proprietors names it is not 'open' in the same way the land register is <p data-wrapper=true>Complete a separate&#160;<a href="https://www.gov.uk/government/publications/proprieters-names-search-of-the-index-pn1">form PN1</a>&#160;(which can be downloaded from the forms section of the HM Land Registry website) for each name searched and send to the address given on the form.</p> <p data-wrapper=true>If you are searching against a company that has had various changes of name, you may lodge one form PN1 with a schedule of names on a separate sheet. Listed names should be double spaced to allow annotation.</p> <p data-wrapper=true><a href="https://www.gov.uk/government/publications/searches-of-the-index-of-proprietors-names/practice-guide-74-searches-of-the-index-of-proprietors-names">Practice guide 74: searches of the index of proprietors’ names</a>&#160;contains useful tips on searching against private individuals, organisations, and public bodies.</p> <p data-wrapper=true>Send the completed form with the&#160;<a href="https://www.gov.uk/guidance/hm-land-registry-information-services-fees#other-fees">correct fee</a>&#160;to the address shown on the form. Make sure the fee paid panel is completed with the appropriate fee.</p> <p data-wrapper=true>If you are not a conveyancer, trustee in bankruptcy, Official Receiver or personal representative and are searching against the name of a private individual, you also need to complete an&#160;<a href="https://www.gov.uk/government/publications/iopn-search-verify-identity-pn1id">index of proprietors’ names ID form</a>&#160;and enclose it, along with evidence of your identity, when making your application.</p> <p data-wrapper=true>You may ask for the search results to be restricted to either the proprietorship or charges register, but by default the search result will show both.</p> <p data-wrapper=true>If you are making a search against someone whose property you have a general interest in, you will need to explain the nature of the interest in panel 7 of form PN1 and enclose evidence of your entitlement to make the search with your application, such as a copy of your appointment as trustee in bankruptcy, probate or letters of administration.</p> <p data-wrapper=true>If you do not enclose the necessary evidence, your application will be rejected.</p> <p data-wrapper=true>in matters of criminal proceedings, tax liability or insolvency, police and certain other organisations are entitled to apply using&#160;<a href="https://www.gov.uk/government/publications/court-proceedings-insolvency-and-tax-liability-information-access-cit">form CIT</a>&#160;which can be downloaded from the Land Registry website.</p> <p data-wrapper=true>Results of an index of proprietors’ names search cannot distinguish between different persons or organisations that have the same name.</p>

Thanks - does having a county court judgement against the individual allow me to use PN1 service (if form is correctly populated and ID provided)?

Abdul - we don't deal with such applications via this forum so cannot be definitive but my reading of section 2 of the PG which explains who may apply, suggests your having a CCJ is not sufficient to enable you to complete the search as described.<br> I would suggest, as you are aware that they own properties outright, that you refer to PG 76 and accompanying algorithms for guidance -&#160;<a href="https://www.gov.uk/government/publications/charging-orders">Charging orders (PG76) - GOV.UK</a>&#160;and also, if you know of any properties then search online for a fee to check/confirm ownership -&#160;<a href="https://www.gov.uk/search-property-information-land-registry">Search for land and property information - GOV.UK</a>&#160;<br> You may also wan t to seek legal advice as to what a CCJ orders and it's impact on the defendant and any property owned although I suspect you may already be aware&#160;<br> &#160;
